OÂWIADCZENIE RZĄDOWE z dnia 15 października 2007 r. w sprawie tymczasowego stosowania Konwencji sporządzonej na podstawie artykułu K.3 Traktatu o Unii Europejskiej w sprawie wzajemnej pomocy i współpracy między administracjami celnymi, sporządzonej w Brukseli dnia 18 grudnia 1997 r. Podaje się niniejszym do wiadomości, że na podstawie ustawy z dnia 8 lipca 2005 r. o ratyfikacji Konwencji sporządzonej na podstawie artykułu K.3 Traktatu o Unii Europejskiej w sprawie wzajemnej pomocy i współpracy między administracjami celnymi, sporządzonej w Brukseli dnia 18 grudnia 1997 r. (Dz. U. z 2005 r. Nr 150, poz. 1252), Prezydent Rzeczypospolitej Polskiej ratyfikował dnia 26 września 2005 r. wyżej wymienioną konwencję. Zgodnie z artykułem 32 ustęp 4, konwencja jest tymczasowo stosowana od dnia 28 kwietnia 2001 r. Zgodnie z artykułem 32 ustęp 4, konwencja jest tymczasowo stosowana w stosunku do Rzeczypospolitej Polskiej od dnia 2 lutego 2006 r. Przy składaniu dokumentu ratyfikacyjnego złożono następujące deklaracje: Deklaracja zgodnie z art. 20 ust. 8 (pościg transgraniczny): „Rzeczpospolita Polska oświadcza, że art. 20 niniejszej konwencji nie ma mocy obowiązującej względem Rzeczypospolitej Polskiej.” Deklaracja zgodnie z art. 21 ust. 5 (nadzór transgraniczny): „Rzeczpospolita Polska oświadcza, że art. 21 niniejszej konwencji może być stosowany przez właściwe organy innych państw członkowskich względem Rzeczypospolitej Polskiej na zasadzie wzajemności. Rzeczpospolita Polska oświadcza również, że funkcjonariusze właściwych organów państw członkowskich mogą wnieść broń służbową na terytorium Rzeczypospolitej Polskiej z prawem użycia wyłącznie w przypadku obrony koniecznej, określonej w art. 25 ustawy z dnia 6 czerwca 1997 r. — Kodeks karny (Dz. U. Nr 88, poz. 553, z późn. zm.). Rzeczpospolita Polska oświadcza, że artykuł 21 ust. 3 lit. d niniejszej konwencji może być stosowany przez właściwe organy innych państw członkowskich względem Rzeczypospolitej Polskiej na zasadzie wzajemności.” Deklaracja zgodnie z art. 23 ust. 5 (dochodzenia niejawne): „Rzeczpospolita Polska oświadcza, że art. 23 niniejszej konwencji może być stosowany przez właściwe organy innych państw członkowskich względem Rzeczypospolitej Polskiej na zasadzie wzajemności.” Deklaracja zgodnie z art. 26 ust. 4: „Rzeczpospolita Polska oświadcza, że deklaracja zgodnie z art. 26 ust. 4 zostanie złożona przez Rzeczpospolitą Polską w terminie późniejszym.” Deklaracja zgodnie z art. 32 ust. 4: „Rzeczpospolita Polska oświadcza, że będzie stosować niniejszą konwencję z wyjątkiem art. 26 w stosunku do tych państw członkowskich, które złożyły taką samą deklarację.”

Jednocześnie podaje się do wiadomości co następuje:

1) Następujące państwa stosują lub będą stosowały tymczasowo ww. konwencję od następującego dnia: Republika Austrii Królestwo Belgii Republika Bułgarii Republika Cypryjska Republika Czeska Królestwo Danii Republika Estońska Republika Finlandii Republika Francuska Królestwo Hiszpanii 7 grudnia 2004 r. 14 czerwca 2007 r. 3 maja 2007 r. 27 października 2007 r. 28 kwietnia 2005 r. 28 listopada 2002 r. 11 maja 2005 r. 25 sierpnia 2004 r. 28 kwietnia 2001 r. 3 maja 2001 r.

2) Podane niżej państwa tymczasowo stosujące konwencję złożyły następujące deklaracje i zastrzeżenia:

Republika Austrii Deklaracja zgodnie z artykułem 20 ust. 6 konwencji: „A. W odniesieniu do wspólnej granicy między Republiką Austrii a Republiką Federalną Niemiec: Funkcjonariusze administracji celnej, wyznaczeni na mocy artykułu 20 ust. 1 konwencji będą prowadzić pościg zgodnie z następującymi procedurami: a) funkcjonariusze prowadzący pościg będą mieli prawo dokonać zatrzymania zgodnie z artykułem 20 ust. 2 lit. b oraz ust. 4 i 5; b) pościg nie będzie ograniczony pod względem czasu i przestrzeni (artykuł 20 ust. 3 lit. b). B. W odniesieniu do wspólnej granicy między Republiką Austrii a Republiką Włoską: Funkcjonariusze administracji celnej wyznaczeni na mocy artykułu 20 ust. 1 konwencji będą prowadzić pościg zgodnie z następującymi procedurami: a) funkcjonariusze prowadzący pościg nie będą mieli prawa do zatrzymania (artykuł 20 ust. 2 lit. a); b) pościg może być prowadzony na odległość 20 kilometrów w przypadku autostrad, a w pozostałych przypadkach na odległość 10 kilometrów (artykuł 20 ust. 3 lit. a).” Deklaracja zgodnie z artykułem 23 ust. 5 konwencji: „Zgodnie z artykułem 23 ust. 5 (dochodzenie niejawne) Konwencji w sprawie wzajemnej pomocy i współpracy między administracjami celnymi, Republika Austrii oświadcza, że zezwoli na działania w drodze dochodzenia niejawnego tylko w przypadku, gdy w innym państwie członkowskim toczy się postępowanie karne w związku z przestępstwami, które wypełniają warunki zastosowania Europejskiego nakazu aresztowania, oraz gdy wyjaśnienie stanu faktycznego byłoby niezwykle trudne bez zastosowania proponowanych środków dochodzeniowych.” Declaration pursuant to Article 20(6) of the Convention: „A. With respect to the common border between the Republic of Austria and the Federal Republic of Germany: Customs administration officers to be specified pursuant to Article 20(1) of the Convention will carry out pursuit in accordance with the following procedures: (a) the pursuing officers will be given the right to apprehend in accordance with Article 20(2)(b),(4) and (5); (b) the pursuit will not be subject to any limit in space or time (Article 20 (3)(b)). B. With respect to the common border between the Republic of Austria and the Italian Republic: Customs administration officers to be specified pursuant to Article 20(1) of the Convention will carry out pursuit in accordance with the following procedures: (a) the pursuing officers will not have the right to apprehend (Article 20(2)(a)); (b) the pursuit may be carried out over a distance of 20 kilometres in the case of motorways and, otherwise, over a distance of up to 10 kilometres (Article 20(3)(a)).” Declaration pursuant to Article 23(5) of the Convention: „Pursuant to Article 23(5) (Covert investigations) of the Convention on Mutual Assistance and Co-operation between Customs Administrations, the Republic of Austria declares that it will allow operations by covert investigators only if, in the other Member State, criminal proceedings are pending in respect of offences which fulfil the conditions for the issue of a European arrest warrant and it would be completely impossible or extremely difficult to elucidate the facts without recourse to the proposed covert operation.”

Declaration pursuant to Article 26(4) of the Convention:

„Republika Austrii uznaje jurysdykcję Trybunału Sprawiedliwości Wspólnot Europejskich na mocy artykułu 26 ust. 5 lit. b.” Deklaracja w sprawie artykułu 26 Konwencji: „Republika Austrii zastrzega sobie prawo do ustanowienia regulacji prawnych w ustawodawstwie krajowym, zgodnie z którymi, ilekroć kwestia związana z wykładnią Konwencji w sprawie pomocy wzajemnej i współpracy między administracjami celnymi zostanie podniesiona w sprawie toczącej się przed krajowym sądem lub trybunałem, od którego decyzji prawo krajowe nie przewiduje możliwości odwoławczych, tenże sąd lub trybunał będzie zobowiązany przekazać sprawę Trybunałowi Sprawiedliwości Wspólnot Europejskich.” Deklaracja zgodnie z artykułem 32 ust. 4 konwencji: „Zgodnie z artykułem 32 ust. 4, Republika Austrii oświadcza, że do czasu wejścia w życie konwencji, z wyłączeniem artykułu 26, konwencja ma zastosowanie w stosunkach z tymi państwami członkowskimi, które złożyły podobne oświadczenie. Oświadczenie takie staje się skuteczne po upływie dziewięćdziesięciu dni od daty jego złożenia.”

„The Republic of Austria recognizes the jurisdiction of the Court of Justice of the European Communities pursuant to Article 26(5)((b).” Declaration on Article 26 of the Convention: „The Republic of Austria reserves the right to make provision in its national law to the effect that, where a question relating to the interpretation of the Convention on Mutual Assistance and Cooperation between Customs Administrations is raised in a case pending before a national court or tribunal against whose decision there is no judicial remedy under national law, that court or tribunal will be required to refer the matter to the Court of Justice of the European Communities.” Declaration pursuant to Article 32(4) of the Convention: „In accordance with Article 32(4) the Republic of Austria declares that, until its entry into force, this Convention, with the exception of Article 26 thereof, shall apply to its relations with Member States that have made the same declaration. This declaration shall take effect ninety days after the date of deposit thereof.”

Królestwo Belgii Deklaracja w rozumieniu artykułu 20 ust. 6 konwencji w sprawie pomocy wzajemnej i współpracy między administracjami celnymi w odniesieniu do wspólnych granic Królestwa Belgii z Królestwem Niderlandów, Wielkim Księstwem Luksemburga, Republiką Federalną Niemiec i Republiką Francuską: a) Wspólne granice Królestwa Belgii z Królestwem Niderlandów Właściwi funkcjonariusze Królestwa Niderlandów będą korzystali z prawa do pościgu na terytorium Królestwa Belgii w odniesieniu do stosowania prawa do zatrzymania, jego zakresu terytorialnego i sytuacji, w których prawo to może być stosowane: odnośnie do naruszeń, o których mowa w artykule 19 ust. 2 lit. a, b i d niniejszej Konwencji, zgodnie z odpowiednimi przepisami artykułu 27 Traktatu w sprawie ekstradycji i wzajemnej pomocy w sprawach karnych zawartego przez państwa Beneluksu dnia 27 czerwca 1962 r., zmienionego na mocy protokołu z dnia 11 maja 1974 r.; odnośnie do naruszeń, o których mowa w artykule 19 ust. 2 lit. c niniejszej konwencji — zgodnie z odpowiednimi przepisami artykułu 24 Konwencji w sprawie współpracy administracyjnej i prawnej w zakresie uregulowań, odnoszących się do osiągania celów Unii Gospodarczej państw Beneluksu z dnia 29 kwietnia 1969 r. i Protokołu dodatkowego zawierającego szczególne przepisy dotyczące opodatkowania. Declaration, within the meaning of Article 20(6) of the Convention on Mutual Assistance and Cooperation between Customs Administrations, relating to the common borders of the Kingdom of Belgium with the Kingdom of the Netherlands, the Grand Duchy of Luxembourg, the Federal Republic of Germany and the French Republic: (a) Common borders of the Kingdom of Belgium with the Kingdom of the Netherlands On Belgian territory the competent officers of the Kingdom of the Netherlands will exercise the right of pursuit, as regards application of the right to apprehend, the territorial scope thereof and the events concerning which that right may be applied: with regard to the infringements referred to in Article 19(2)(a), (b) and (d) of this Convention, in accordance with the relevant provisions of Article 27 of the Benelux Treaty on Extradition and Mutual Assistance in Criminal Matters of 27 June 1962, as amended by the Protocol of 11 May 1974; with regard to the infringements referred to in Article 19(2)(c) of this Convention, in accordance with the relevant provisions of Article 24 of the Convention on administrative and judicial cooperation in the field of regulations relating to the achievement of the objectives of the Benelux Economic Union of 29 April 1969 and of the Additional Protocol thereto containing specific provisions on taxation.

b) Wspólne granice Królestwa Belgii z Wielkim Księstwem Luksemburga Właściwi funkcjonariusze Wielkiego Księstwa Luksemburga będą korzystać z prawa do pościgu na terytorium Królestwa Belgii w odniesieniu do stosowania prawa do zatrzymania, jego zakresu terytorialnego i sytuacji, w których prawo to może być stosowane: odnośnie do naruszeń, o których mowa w artykule 19 ust. 2 lit. a, b i d niniejszej konwencji, zgodnie z odpowiednimi przepisami artykułu 27 Traktatu w sprawie ekstradycji i wzajemnej pomocy w sprawach karnych zawartego przez państwa Beneluksu dnia 27 czerwca 1962 r., zmienionego przez Protokół z dnia 11 maja 1974 r.; odnośnie do naruszeń, o których mowa w artykule 19 ust. 2 lit. c niniejszej konwencji, zgodnie z odpowiednimi przepisami artykułu 24 konwencji w sprawie współpracy administracyjnej i prawnej w zakresie uregulowań odnoszących się do osiągania celów Unii Gospodarczej państw Beneluksu z dnia 29 kwietnia 1969 r. i Protokołu dodatkowego zawierającego szczególne przepisy dotyczące opodatkowania. c) Wspólne granice Królestwa Belgii z Republiką Federalną Niemiec Właściwi funkcjonariusze Republiki Federalnej Niemiec będą korzystać z prawa do pościgu na terytorium Królestwa Belgii w odniesieniu do stosowania prawa do zatrzymania, jego zakresu terytorialnego i sytuacji, w których prawo to może być stosowane, zgodnie z następującymi warunkami: — prawo do zatrzymania w szczególnie pilnych przypadkach, zgodnie z artykułem 20 ust. 2 lit. b; — prawo do pościgu bez ograniczenia w czasie lub przestrzeni; — prawo do pościgu osób obserwowanych podczas popełniania jednego z naruszeń, określonych w artykule 19 ust. 2, które mogłoby dać podstawę do ekstradycji, lub uczestniczących w takim naruszeniu. d) Wspólne granice Królestwa Belgii z Republiką Francuską Właściwi funkcjonariusze Republiki Francuskiej będą korzystali z prawa do pościgu na terytorium Królestwa Belgii w odniesieniu do stosowania prawa do zatrzymania, jego zakresu terytorialnego i sytuacji, w których prawo to może być stosowane, zgodnie z następującymi warunkami: — bez prawa do zatrzymania; — prawo do pościgu bez ograniczenia w czasie lub przestrzeni; — prawo do pościgu osób obserwowanych podczas popełniania jednego z naruszeń, określonych w artykule 19 ust. 2, które mogłoby dać podstawę do ekstradycji, lub uczestniczących w takim naruszeniu.

(b) Common borders of the Kingdom of Belgium with the Grand Duchy of Luxembourg On Belgian territory the competent officers of the Grand Duchy of Luxembourg will exercise the right of pursuit, as regards application of the right to apprehend, the territorial scope thereof and the events concerning which that right may be applied: with regard to the infringements referred to in Article 19 (2)(a), (b) and (d) of this Convention, in accordance with the relevant provisions of Article 27 of the Benelux Treaty on Extradition and Mutual Assistance in Criminal Matters of 27 June 1962, as amended by the Protocol of 11 May 1974; with regard to the infringements referred to in Article 19(2)(c) of this Convention, in accordance with the relevant provisions of Article 24 of the Convention on administrative and judicial cooperation in the field of regulations relating to the achievement of the objectives of the Benelux Economic Union of 29 April 1969 and of the Additional Protocol containing special provisions on taxation. (c) Common borders of the Kingdom of Belgium with the Federal Republic of Germany On Belgian territory the competent officers of the Federal Republic of Germany will exercise the right of pursuit, as regards application of the right to apprehend, the territorial scope thereof and the events concerning which that right may be applied, in accordance with the following qualifications: — right to apprehend in extremely urgent cases as provided for in Article 20(2)(b); — right of pursuit without limit in space or time; — right of pursuit of individuals observed in the act of committing one of the infringements referred to in Article 19(2) which could give rise to extradition, or participating in such an infringement. (d) Common borders of the Kingdom of Belgium with the French Republic On Belgian territory the competent officers of the French Republic will exercise the right of pursuit, as regards application of the right to apprehend, the territorial scope thereof and the events concerning which that right may be applied, in accordance with the following qualifications: — no right to apprehend; — right of pursuit without limit in space or time; — right of pursuit of individuals observed in the act of committing one of the infringements referred to in Article 19(2) which could give rise to extradition, or participating in such an infringement.

„Zgodnie z artykułem 32 ust. 4 konwencji, Królestwo Belgii oświadcza, że do chwili wejścia konwencji w życie, w zakresie, w jakim to dotyczy Belgii, konwencja ma zastosowanie, z wyjątkiem artykułu 26, w jej stosunkach z państwami członkowskimi, które złożyły podobne oświadczenie.” „Zgodnie z postanowieniami zawartymi w artykule 26 ust. 5 lit. b konwencji, Królestwo Belgii oświadcza, że uznaje jurysdykcję Trybunału Sprawiedliwości Wspólnot Europejskich.”

„In accordance with Article 32(4) of the Convention, the Kingdom of Belgium declares that, until the Convention enters into force, as far as Belgium is concerned, the Convention, with the exception of Article 26 thereof, is to apply to its relations with Member States that have made a similar declaration.” „The Kingdom of Belgium declares that it accepts the jurisdiction of the Court of Justice of the European Communities in accordance with the arrangements laid down in Article 26(5)(b) of the Convention.”

Republika Bułgarii Deklaracje: „Zgodnie z artykułem 20 ust. 8 konwencji, Republika Bułgarii oświadcza, że nie jest związana postanowieniami artykułu 20.” „Zgodnie z artykułem 21 ust. 5 konwencji, Republika Bułgarii oświadcza, że nie jest związana postanowieniami artykułu 21.” „Zgodnie z artykułem 23 ust. 5 konwencji, Republika Bułgarii oświadcza, że nie jest związana postanowieniami artykułu 23.” „Zgodnie z artykułem 26 ust. 4 konwencji, Republika Bułgarii oświadcza, że uznaje jurysdykcję Trybunału Sprawiedliwości Wspólnot Europejskich zgodnie z procedurami ustanowionymi w artykule 26 ust. 5 lit. b. Zgodnie z artykułem 32 ust. 4 konwencji, Republika Bułgarii oświadcza, że w zakresie, w jakim jej to dotyczy, z wyjątkiem artykułu 26, ma ona zastosowanie w stosunkach z tymi państwami członkowskimi, które złożyły podobne oświadczenie.” Declarations: „In accordance with Article 20, paragraph 8 of the Convention the Republic of Bulgaria declares that it is not bound by the provisions of Article 20.” „In accordance with Article 21, paragraph 5 of the Convention the Republic of Bulgaria declares that it is not bound by the provisions of Article 21.” „In accordance with Article 23, paragraph 5 of the Convention the Republic of Bulgaria declares that it is not bound by the provisions of Article 23.” „In accordance with Article 26, paragraph 4 of the Convention the Republic of Bulgaria declares that it accepts the jurisdiction of the Court of Justice of the European Communities in accordance with the procedures laid down in Article 26 (5)(b).” „In accordance with Article 32, paragraph 4 of the Convention the Republic of Bulgaria declares that as far as it is concerns this Convention, with the exception of Article 26 thereof, will apply it in its relations with the Member States which have made the same declaration.”

Republika Cypryjska Deklaracja: „Odnośnie do artykułu 32 ust. 4 konwencji sporządzonej na podstawie artykułu K.3 traktatu o Unii Europejskiej w sprawie wzajemnej pomocy i współpracy między administracjami celnymi, Republika Cypryjska oświadcza, że do chwili wejścia Konwencji w życie, ma ona zastosowanie, z wyłączeniem artykułu 26, do Republiki Cypryjskiej w jej stosunkach z państwami członkowskimi, które złożyły podobne oświadczenie na podstawie artykułu 32 ust. 4 konwencji.” Declaration: „Pursuant to paragraph (4) of Article 32 of the Convention, drawn up on the basis of Article K.3 of the Treaty on European Union, on Mutual Assistance and Cooperation between Customs Administrations, the Republic of Cyprus declares that, until the Convention enters into force, the Convention shall apply to the Republic of Cyprus, with the exception of Article 26 thereof, in its relations with Member States, which have made the same declaration on the basis of paragraph (4) of Article 32 of the Convention.”

Republika Czeska Deklaracje:

1. Odnośnie do artykułu 1 ust. 2 i artykułu 3 ust. 2: „Republika Czeska oświadcza, że interpretuje określenia „organy sądowe” i „organ sądowy” w artykule 1 ust. 2 i artykule 3 ust. 2 konwencji w znaczeniu deklaraDeclarations:

1. Re Articles 1(2) and 3(2): „The Czech Republic declares that it interprets the terms „judicial authorities” and „judicial authority” in Articles 1(2) and 3(2) of the Convention in the sense of

cji wniesionych stosownie do artykułu 24 Europejskiej konwencji o pomocy prawnej w sprawach karnych, podpisanej w Strasburgu dnia 20 kwietnia 1959 r.”

2. Odnośnie do artykułu 4 ust. 7: „Republika Czeska oświadcza, że w odniesieniu do współpracy na podstawie tytułu IV konwencji wyrażenie „administracje celne” obejmuje także policję Republiki Czeskiej.”

3. Odnośnie do artykułu 20 ust. 1: „Republika Czeska oświadcza, że zezwolenie na podejmowanie działania zgodnie z niniejszym artykułem ma zastosowanie w Republice Czeskiej do funkcjonariuszy organów Administracji Celnej Republiki Czeskiej, którzy mają status organów policji zgodnie z prawem krajowym i do policji Republiki Czeskiej.”

4. Odnośnie do artykułu 20 ust. 6: „Republika Czeska oświadcza, że właściwi funkcjonariusze państw członkowskich prowadzą pościg na terytorium Republiki Czeskiej bez ograniczenia w czasie lub przestrzeni (artykuł 20 ust. 3 lit. b) i mogą zatrzymać ściganą osobę (artykuł 20 ust. 2 lit. b). Takiego zezwolenia nie stosuje się do funkcjonariuszy państw członkowskich, które całkowicie wyłączyły stosowanie niniejszego artykułu zgodnie z jego ustępem 8.”

5. Odnośnie do artykułu 21 ust. 1: „Republika Czeska oświadcza, że zezwolenie do działania zgodnie z niniejszym artykułem stosuje się w Republice Czeskiej do organów Administracji Celnej Republiki Czeskiej, które mają status organów policyjnych zgodnie z prawem krajowym, oraz do policji Republiki Czeskiej.”

6. Odnośnie do artykułu 21 ust. 5: „Republika Czeska oświadcza, że przyjmuje postanowienia artykułu 21 z zastrzeżeniem następujących warunków: nadzór transgraniczny może być wykonywany zgodnie z artykułem 21 ust. 1, 2 i 3 tylko wtedy, gdy są istotne podstawy do przypuszczania, że osoby będące pod obserwacją biorą udział w jednym z naruszeń, o których mowa w artykule 19 ust 2, które są zagrożone maksymalnymi karami przynajmniej jednego roku pozbawienia wolności w kraju wnioskującym, oraz tylko dla celów dowodowych postępowania karnego.”

7. 2. Re Article 4(7): „The Czech Republic declares that, as regards cooperation under Title IV of the Convention, „customs administrations” shall also include the police of the Czech Republic.”

3. Re Article 20(1): „The Czech Republic states that the authorisation to act pursuant to this Article shall apply in the Czech Republic to officers of the authorities of the Customs Administration of the Czech Republic, who shall have the status of police authorities under national law, and to the police of the Czech Republic.”

4. Re Article 20(6): „The Czech Republic declares that the competent officers of the Member States shall exercise hot pursuit in the territory of the Czech Republic without limit in space or time (Article 20(3)(b)) and may apprehend the person pursued (Article 20(2)(b)). This authorisation shall not apply to officers of Member States which have completely excluded application of this Article pursuant to paragraph 8 thereof.”

5. Re Article 21(1): „The Czech Republic states that authorisation to act pursuant to this Article shall apply in the Czech Republic to the authorities of the Customs Administration of the Czech Republic, which shall have the status of police authorities under national law, and to the police of the Czech Republic.”

6. Re Article 21(5): „The Czech Republic declares that it accepts the provisions of Article 21 subject to the following conditions: Cross-border surveillance may be carried out pursuant to Article 21(1), (2) and (3) only if there are serious grounds for believing that the persons under observation are involved in one of the infringements referred to in Article 19(2), which carry the maximum sentence of at least one year of imprisonment in the requesting State, and only for the purpose of evidence in criminal proceedings.”

7. Re Article 26(4): „The Czech Republic declares that it accepts the jurisdiction of the Court of Justice of the European Communities under Article 26(5)(b) of the Convention drawn up on the basis of Article K.3 of the Treaty on European Union, on mutual assistance and cooperation between customs administrations.

Republika Czeska zastrzega sobie prawo do ustanowienia w ustawodawstwie krajowym, że ilekroć kwestia związana z wykładnią Konwencji w sprawie pomocy wzajemnej i współpracy między administracjami celnymi zostanie podniesiona w sprawie toczącej się przed krajowym sądem lub trybunałem, od którego decyzji prawo krajowe nie przewiduje możliwości odwoławczych, tenże sąd lub trybunał będzie zobowiązany przekazać sprawę Trybunałowi Sprawiedliwości Wspólnot Europejskich.”

8. Odnośnie do artykułu 32 ust. 4: „Republika Czeska oświadcza, na warunkach artykułu 32 ust. 4, że w zakresie, w jakim jej to dotyczy, z wyjątkiem artykułu 26, konwencja ma zastosowanie w stosunkach z tymi państwami członkowskimi, które złożyły podobne oświadczenie.”

The Czech Republic reserves the right to provide in its national law that, where a question relating to the interpretation of the Convention drawn up on the basis of Article K.3 of the Treaty on European Union, on mutual assistance and cooperation between customs administrations is raised in a case pending before a national court or tribunal against whose decision there is no judicial remedy under national law, that court or tribunal be required to refer the matter to the Court of Justice of the European Communities.”

8. Re Article 32(4): „The Czech Republic declares, in terms of Article 32 paragraph 4, that as far as it is concerned this Convention, with the exception of Article 26 thereof, shall apply to its relations with the Member States that have made the same declaration.”

Królestwo Danii Deklaracje: „W związku z ratyfikacją Konwencji Neapolitańskiej II Dania pragnie złożyć poniższe deklaracje. Dania złożyła poprzednio deklaracje dotyczące artykułu 1 ust. 2, artykułu 3 ust. 2, artykułu 4 ust. 3 oraz artykułu 6 ust. 4 Konwencji Neapolitańskiej II. Zakładamy, że deklaracje te pozostają załączone do konwencji. W związku z tym, że artykuł 4 nie jest podzielony na ustępy, lecz jest numerowanym wykazem, należy wyjaśnić, że deklaracja odnosi się do punktu 3 w wykazie artykułu 4 (nie ustępu 3). Ustawa nr 465 z dnia 7 czerwca 2001 r. w sprawie zmian do kodeksu karnego oraz kodeksu postępowania karnego (w odniesieniu do paserstwa i innych związanych z nim czynów oraz wykorzystania technologii informatycznej w dochodzeniach) wprowadziła ogólny przepis dotyczący paserstwa w dziale 290 kodeksu karnego. W tym samym czasie działy 191a oraz 284 kodeksu karnego zostały uchylone. Dlatego odniesienie do tych działów w deklaracji dotyczącej artykułu 4 ust. 3 tiret trzecie, nie jest już zgodne z kodeksem karnym. W związku z tym deklaracja powinna zostać zmieniona w następujący sposób: „Odnośnie do artykułu 4 ust. 3 tiret trzecie Królestwo Danii oświadcza, w zakresie, w jakim jego to dotyczy, że artykuł 4 ust. 3 tiret trzecie, stosuje się do przestępstw, odnośnie do których paserstwo jest zawsze karalne zgodnie z prawem duńskim (dział 290 kodeksu karnego).” W momencie podpisywania konwencji Dania złożyła również deklarację zgodnie z artykułem 20 ust. 6 o warunkach pościgu: „Dania oświadcza, że pościg wkraczający przez granicę na terytorium Danii ze Szwecji i Niemiec może odbywać się tylko na następujących warunkach: — władze szwedzkie i niemieckie mają prawo do kontynuowania pościgu prowadzonego na terytorium duńskim na odległość do 25 kilometrów od granicy; — władze szwedzkie i niemieckie nie mają prawa dokonywać zatrzymań osób na terytorium duńskim.” Declarations: „In connection with the ratification of the Naples II Convention, Denmark wishes to make the declarations set out below. Denmark has previously made declarations on Articles 1(2), 3(2), 4(3) and 6(4) of the Naples II Convention. We assume that those declarations remain annexed to the Convention. As Article 4 is not divided into paragraphs, but is a numbered list, it should be made clear that the declaration relates to item number 3 on the list in Article 4 (not paragraph 3). Law No 465 of 7 June 2001 on amendments to the Criminal Code and to the Administration of Justice Act (receiving stolen goods and other subsequent assistance, and IT investigations) introduced a general provision on receiving stolen goods in Section 290 of the Criminal Code. At the same time, Sections 191a and 284 of the Criminal Code were repealed. The reference to these sections in the declaration on the third indent of Article 4(3) are therefore no longer in accordance with the Criminal Code. The declaration should therefore be amended as follows: „Re Article 4(3), third indent Denmark declares, as far as it is concerned, that Article 4(3), third indent, applies only to the predicate offences in respect of which at any time receiving stolen goods is punishable under Danish law (Section 290 of the Criminal Code).” On signing the Convention, Denmark also made a declaration under Article 20(6) on the conditions for pursuit: „Denmark declares that pursuit into Denmark over the borders from Sweden and Germany may only take place on the following conditions: — the Swedish and German authorities have the right to continue an ongoing pursuit on Danish territory for a distance of up to 25 km from the border; — the Swedish and German authorities do not have the right to apprehend persons in Danish territory.”

Ponieważ artykuły te przewidują, że w chwili składania dokumentów przyjęcia do konwencji państwo członkowskie może oświadczyć, że nie jest w całości lub częściowo związane tymi artykułami, uważamy, że te deklaracje powinny być złożone ponownie. 23. Denmark has also made declarations on Article 20 and Article

21. As those Articles state that when depositing its instruments of adoption of the Convention, a Member State may declare that it is not bound by that Article or by part thereof, we believe that these declarations should be presented once again. The Danish declarations: „Re Article 20(4)(e) Denmark declares, as far as it is concerned, that pursuing customs officers may carry their service weapons over the land border, unless Denmark has expressly objected to this. Denmark also declares, as far as it is concerned, that if the pursuit is continued into Danish territory by boat or aeroplane, the pursing customs officers may not in principle carry their service weapons.

Re Article 20(8) Denmark declares that its accepts the provisions of Article 20, subject to the following conditions: In case of a hot pursuit exercised by the customs authorities of another Member State at sea or through the air, such pursuit may be extended to Danish territory, including Danish territorial waters and the airspace above Danish territory and territorial waters, only if the competent Danish authorities have received prior notice thereof. Re Article 21(3)(d) Denmark declares, as far as it is concerned, that customs officers conducting cross-border observation may carry their service weapons over the land border, unless Denmark has expressly objected to this. Denmark also declares, as far as it is concerned, that if the observation is continued into Danish territory by boat or aeroplane, the customs officers conducting the observation may not in principle carry their service weapons. Justice of the European Communities has jurisdiction, pursuant to the conditions laid down in Article 26(5)(b) of this Convention, to give preliminary rulings concerning the interpretation of the Convention.” „Whereas, pursuant to Article 33(5) of the Convention, the Seimas of the Republic of Lithuania states that in case this Convention has not entered into force by the time of the deposit by the Republic of Lithuania of its instrument of accession, the Convention, except for its Article 23, shall apply in respect of the relations of the Republic of Lithuania with the other Member States of the European Union who have made the same declaration.”

Wielkie Księstwo Luksemburga Deklaracje: „1. W odniesieniu do granicy między Wielkim Księstwem Luksemburga a Królestwem Belgii, pościg będzie prowadzony zgodnie z uzgodnieniami określonymi w artykule 27 Traktatu w sprawie ekstradycji i wzajemnej pomocy w sprawach karnych, zawartego przez państwa Beneluksu dnia 27 czerwca 1962 r., zmienionego na mocy Protokołu z dnia 11 maja 1974 r. W odniesieniu do naruszeń, o których mowa w artykule 19 ust. 2 lit. a, b i d niniejszej konwencji oraz w odniesieniu do naruszeń, o których mowa w artykule 19 ust. 2 lit. c, zgodnie z zasadami zawartymi w artykule 24 Konwencji w sprawie współpracy administracyjnej i prawnej w zakresie uregulowań odnoszących się do osiągania celów Unii Gospodarczej państw Beneluksu z dnia 29 kwietnia 1969 r. i Protokołu dodatkowego zawierającego szczególne przepisy dotyczące opodatkowania.

W odniesieniu do granicy między Wielkim Księstwem Luksemburga a Republiką Federalną Niemiec, pościg na terenie Wielkiego Księstwa Luksemburga będzie prowadzony przez funkcjonariuszy, o których mowa w artykule 20 ust. 1, zgodnie z następującymi zasadami: a) funkcjonariusze będą mieli prawo do zatrzymania zgodnie z warunkami określonymi w artykule 20 ust. 2 i 5; b) pościg może być prowadzony tylko w promieniu 10 kilometrów od granicy.

3. 3. As regards the border between the Grand Duchy of Luxembourg and the French Republic, pursuit by the officers referred to in Article 20 will be effected in the territory of the Grand Duchy of Luxembourg in accordance with the following arrangements: (a) officers will have no right to apprehend; (b) pursuit may be effected only within a 10-kilometre radius of the border.” „The Grand Duchy of Luxembourg accepts the jurisdiction of the Court of Justice of the European Communities in accordance with the arrangements laid down in Article 26(5)(b) of the Convention.”

„The Grand Duchy of Luxembourg declares that it will apply in advance the Convention drawn up on the basis of Article K.3 of the Treaty on European Union, on Mutual Assistance and Cooperation between Customs Administrations, with the exception of Article 26 thereof, in its relations with Member States which have made or make a similar declaration on the basis of Article 32(4) of the Convention.” Reservation: „The particular forms of cooperation provided for in Articles 21 to 24 of the Convention shall be subject to the agreement of the State Public Prosecutor having territorial jurisdiction. In the case of hot pursuit provided for in Article 20 of the Convention, the request to cease the pursuit shall come from the State Public Prosecutor having territorial jurisdiction.”

Declaration pursuant to Article 26(5)(b):

Deklaracja na mocy artykułu 26 ust. 5 lit. b: „Niderlandy deklarują, że uznają jurysdykcję Trybunału Sprawiedliwości Wspólnot Europejskich w kwestii wydawania orzeczenia prejudycjalnego na wniosek każdego sądu lub trybunału Niderlandów w sprawie wykładni konwencji przy rozstrzyganiu spraw toczących się przed sądem lub trybunałem, jeśli ten sąd lub trybunał uzna, że decyzja w tej kwestii jest niezbędna do wydania wyroku.” Deklaracja na mocy artykułu 32 ust. 4: „Niderlandy deklarują, że do chwili wejścia w życie konwencji, konwencję stosuje się, z wyjątkiem artykułu 26, w odniesieniu do stosunków Niderlandów z państwami członkowskimi, które złożyły taką samą deklarację.”

„The Netherlands declares that it accepts the authority of the Court of Justice of the European Community to give a preliminary ruling, at the request of any court or tribunal of the Netherlands, on a question concerning the interpretation of the Convention raised in a case pending before it, if that court or tribunal considers that a decision on the question is necessary to enable it to give judgment.” Declaration pursuant to Article 32(4): „The Netherlands declares that, until the Convention enters into force, the Convention shall apply to the Netherlands, with the exception of Article 26 thereof, in its relations with Member States that have made the same declaration.”

Republika Federalna Niemiec Deklaracje: „Artykuł 20 ust. 6 (pościg): Uprawnieni funkcjonariusze państw członkowskich będą korzystali z prawa do pościgu na terytorium Republiki Federalnej Niemiec bez ograniczeń w czasie lub przestrzeni (artykuł 20 ust. 4 lit. b) oraz będą mieli prawo do zatrzymania (artykuł 20 ust. 2). Funkcjonariusze państw członkowskich, które w całości wyłączyły stosowanie niniejszego artykułu zgodnie z ustępem 8, nie będą mieli tego prawa. Artykuł 26 (uprawnienie Europejskiego Trybunału Sprawiedliwości do wydawania orzeczenia prejudycjalnego): Republika Federalna Niemiec składa niniejszym deklarację na mocy artykułu 26 ust. 5 lit. b. Każdy sąd lub trybunał ma możliwość skierowania sprawy do Trybunału Sprawiedliwości Wspólnot Europejskich o wydanie orzeczenia prejudycjalnego. Slovak Republic will make declaration after conducting consultations with respective Member States.” Re Article 20(8): „The Slovak Republic declares that it accepts the provisions of Article 20 subject to the following conditions: in a case of a hot cross-border pursuit exercised by the customs authorities of another Member State or through the airspace, such pursuit may be extended in the Slovak territory, including the airspace

„Słowenia deklaruje, że nie jest związana artykułem 23.” Na mocy artykułu 26 ust. 4: „Słowenia deklaruje, że uznaje jurysdykcję Trybunału Sprawiedliwości Wspólnot Europejskich do wydawania orzeczeń prejudycjalnych dotyczących wykładni niniejszej konwencji, jak określono w ust. 5 lit. a.” Na mocy artykułu 32 ust. 4: „Słowenia deklaruje, że w zakresie w jakim jej to dotyczy, stosuje niniejszą konwencję, z wyjątkiem artykułu 23, w stosunkach z państwami członkowskimi, które złożyły taką samą deklarację.”

„Slovenia declares that it is not bound by Article 23.” Pursuant to Article 26, paragraph 4: „Slovenia accepts the jurisdiction of the Court of Justice of the European Communities to give preliminary rulings on the interpretation of this Convention as specified in paragraph 5(a).” Pursuant to Article 32, paragraph 4: „Slovenia declares that as far as it is concerned this Convention, with the exception of Article 23 thereof, shall apply to its relations with Member States that have made the same declaration.”

Królestwo Szwecji Deklaracja: „W związku z podpisaniem Konwencji w sprawie pomocy wzajemnej i współpracy między administracjami celnymi, Szwecja oświadcza, w odniesieniu do artykułu 20 ust. 6, że postanowienia ust. 2, 3 i 4 tego artykułu będą stosowane w następujący sposób: w odniesieniu do artykułu 20 ust. 3 będzie miała zastosowanie lit. b.” Deklaracje: „W związku z przyjęciem Konwencji w sprawie pomocy wzajemnej i współpracy między administracjami celnymi Szwecja składa następujące deklaracje: W odniesieniu do artykułu 23 ust. 5 Konwencji o współpracy celnej, Królestwo Szwecji nie zamierza stosować dochodzenia niejawnego jako formy współpracy. W odniesieniu do artykułu 26 ust. 5 lit. b Konwencji o współpracy celnej, wszystkie sądy i trybunały szwedzkie są uprawnione do uzyskania orzeczenia prejudycjalnego w sprawie wykładni konwencji w zakresie niezbędnym do podjęcia decyzji w sprawie lub podniesionej kwestii. W odniesieniu do artykułu 32 ust. 4 Konwencji o współpracy celnej, do momentu wejścia w życie konwencji ma ona zastosowanie w stosunkach Szwecji z państwami, które złożyły taką samą deklarację, z wyjątkiem artykułu 26.” Declaration: „In connection with the signing of the Convention on Mutual Assistance and Cooperation between Customs Administrations, Sweden states, with reference to Article 20(6), that the provisions in paragraphs 2, 3 and 4 of that Article will be implemented in the following way: As regards Articles 20(3), point (b) will apply.” Declarations: „In connection with the adoption of the Convention on Mutual Assistance and Cooperation between Customs Administrations, Sweden makes the following declarations: With reference to Article 23(5) of the Customs Cooperation Convention, Sweden does not intend to apply the covert investigation form of cooperation. With reference to Article 26(5)(b) of the Customs Cooperation Convention, all Swedish courts or tribunals are entitled to obtain a preliminary ruling on the interpretation of the Convention to the extent necessary for a decision in a case or on a matter. With reference to Article 32(4) of the Customs Cooperation Convention, until the Convention enters into force, it shall, with the exception of Article 26 thereof, apply to Sweden’s relations with States that have made the same declaration.”

Republika Węgierska Deklaracje:

1. Do artykułu 20 ust. 6: a) odnośnie do artykułu 20 ust. 2: Funkcjonariusze administracji celnej, określeni zgodnie z artykułem 20 ust. 1 konwencji, nie mają prawa stosowania podczas pościgu na terytorium Republiki Węgierskiej innych środków niż zatrzymanie, zgodnie z artykułem 20 ust. 2 lit. b konwencji. Declarations:

1. To paragraph 6 of Article 20: a) Pursuant to paragraph 2 of Article 20: Customs administrative officers to be specified pursuant to paragraph 1 of Article 20 of the Convention may not take other measures during the pursuit than apprehend in accordance with the subparagraph b) of paragraph 2 of Article 20 of the Convention on the territory of the Republic of Hungary.

Pościg nie podlega ograniczeniu w przestrzeni lub czasie. c) odnośnie do artykułu 20 ustęp. 4: Republika Węgierska wyraża życzenie ustalenia dokładnych warunków mających zastosowanie do pościgu, w dwustronnych porozumieniach z państwami członkowskimi Unii Europejskiej o zapobieganiu i zwalczaniu przestępczości transgranicznej. d) odnośnie do artykułu 20 ust. 8: Deklaracje Republiki Węgierskiej złożone na podstawie artykułu 20 ust. 6 dotyczą tych państw członkowskich, które nie wyłączają stosowania, w całości lub częściowo, postanowień artykułu 20 na podstawie jego ustępu 8.

2. Do artykułu 23 ust. 5: W ramach prowadzenia na terytorium Republiki Węgierskiej dochodzeń niejawnych, o których mowa w artykule 23, poza postanowieniami niniejszej konwencji mają zastosowanie dwustronne porozumienia o zapobieganiu i zwalczaniu przestępczości transgranicznej, jak również porozumienia ad hoc dotyczące przedmiotowych spraw.

3. Do artykułu 26 ust. 4: Zgodnie z artykułem 35 ust. 2 Traktatu o Unii Europejskiej, Republika Węgierska uznaje jurysdykcję Trybunału Wspólnot Europejskich na warunkach określonych w artykule 35 ust. 3 lit. b tego traktatu.

4. Do artykułu 32 ust. 4: Republika Węgierska oświadcza, że do chwili wejścia konwencji w życie, konwencja jest stosowana przez Republikę Węgierską w stosunkach z państwami członkowskimi, które złożyły podobną deklarację o tymczasowym stosowaniu.

The pursuit will not be subject to any limit in space or time. c) Pursuant to paragraph 4 of Article 20: The Republic of Hungary wishes to regulate the detailed conditions of the pursuit in bilateral Agreements on prevention and suppression the cross-border crime with the Member States of the European Union. d) Pursuant to paragraph 8 of Article 20: Declarations of the Republic of Hungary made pursuant to paragraph 6 of Article 20 refer to those Member States, who do not exclude wholly or partly the application of Article 20 pursuant its paragraph 8.

2. To paragraph 5 of Article 23: Pursuant to the application of covert investigation specified in Article 23, in the territory of the Republic of Hungary besides the provisions of this Convention, the bilateral Agreements on prevention and suppression of cross-border crime and ad hoc Agreements referring to certain cases are applicable.

3. To paragraph 4 of Article 26: According to paragraph 2 of Article 35 of the Treaty on European Union, the Republic of Hungary recognizes the jurisdiction of the Court of the European Communities stated in subparagraph b) of paragraph 3 of Article 35 of the Treaty on European Union.

4. To paragraph 4 of Article 32: The Republic of Hungary declares that, until the Convention enters into force, the Convention shall apply to the Republic of Hungary in its relations with Member States that have made the same declaration about the provisional application.

Zjednoczone Królestwo Wielkiej Brytanii i Irlandii Północnej Deklaracja: „Zjednoczone Królestwo deklaruje, że: — artykuł 20 niniejszej konwencji nie ma w stosunku do Zjednoczonego Królestwa mocy obowiązującej; — broń nie może być nigdy wwożona na terytorium Zjednoczonego Królestwa dla celów artykułu 21 niniejszej konwencji; z wyjątkiem artykułu 26, niniejszą konwencję stosuje się na warunkach określonych przez Zjednoczone Królestwo w odniesieniu do jego stosunków z państwami członkowskimi, które złożyły deklarację zgodnie z artykułem 32 ust. 4.” Declaration: „The United Kingdom declares that: — Article 20 of this Convention does not bind it; — weapons may never be carried into its territory for the purposes of Article 21 of this Convention; with the exception of Article 26 thereof, the Convention shall in terms as hereby notified by the United Kingdom apply to its relations with Member States that have made a declaration under Article 32(4).” Minister Spraw Zagranicznych: w z.
