UMOWA między Rządem Rzeczypospolitej Polskiej a Organizacją Współpracy Gospodarczej i Rozwoju o przywilejach i immunitetach Organizacji, sporządzona w Paryżu dnia 16 stycznia 1995 r. W imieniu Rzeczypospolitej Polskiej PREZYDENT RZECZYPOSPOLITEJ POLSKIEJ podaje do powszechnej wiadomości: W dniu 16 stycznia 1995 r. została sporządzona w Paryżu Umowa między Rządem Rzeczypospolitej Polskiej a Organizacją Współpracy Gospodarczej i Rozwoju o przywilejach i immunitetach Organizacji, w następującym brzmieniu: UMOWA między Rządem Rzeczypospolitej Polskiej a Organizacją Współpracy Gospodarczej i Rozwoju o przywilejach i immunitetach Organizacji AGREEMENT between the Government of the Republic of Poland and the Organisation for Economic Co-operation and Development on the privileges and immunities of the Organisation The Government of the Republic of Poland and the Organisation for Economic Co-operation and Development (hereafter called the Contracting Parties), having regard to the Memorandum of Understanding between the Government of the Republic of Poland and the Organisation for Economic Co-operation and Development concerning the programme ”Partners in Transition” signed in Paris on 4 June 1991, having regard to paragraph 25 of the Communique adopted by the Council of the Organisation meeting at ministerial level on 8 June 1994, calling for negotiations with the Republic of Poland concerning membership, having regard to Supplementary Protocol No. 2 to the Convention on the Organisation for Economic Co-operation and Development, in particular its section (d), have agreed as follows: Article 1 For the purposes of this Agreement: ACCORD entre le Gouvernement de la République de Pologne et l’Organisation de Coopération et de Développement Economiques relatif aux privil¯ges et immunités de l’Organisation Le Gouvernement de la République de Pologne et l’Organisation de Coopération et de Développement Economiques (ci-apr¯s les Parties Contractantes), vu le Mémorandum d’accord entre le gouvernement de la République de Pologne et l’Organisation de Coopération et de Développement Economiques concernant le programme ”Partenaires pour la transition” signé ∫ Paris le 4 juin 1991, vu le paragraphe 25 du Communiqué adopté par le Conseil de l’Organisation lors de sa réunion tenue au niveau ministériel le 8 juin 1994 l’invitant ∫ engager des négociations avec la République de Pologne en vue de son adhésion, vu le Protocole Additionnel N° 2 ∫ la Convention relative ∫ l’Organisation de Coopération et de Développement Economiques, et en particulier l’alinéa (d), sont convenus de ce qui suit: Article 1 Aux fins du présent Accord:

Rząd Rzeczypospolitej Polskiej i Organizacja Współpracy Gospodarczej i Rozwoju (zwane dalej Umawiającymi się Stronami), nawiązując do Protokołu Ustaleń (Memorandum of Understanding) między Rządem Rzeczypospolitej Polskiej a Organizacją Współpracy Gospodarczej i Rozwoju w sprawie programu „Partnerzy w Trakcie Przemian” (”Partners in Transition”), podpisanego w Paryżu dnia 4 czerwca 1991 r., nawiązując do paragrafu 25 Komunikatu przyjętego przez spotkanie Rady Organizacji na szczeblu ministrów w dniu 8 czerwca 1994 r., w którym wzywa się do negocjacji z Rzecząpospolitą Polską w sprawie jej członkostwa, nawiązując do Protokołu dodatkowego nr 2 do Konwencji dot. Organizacji Współpracy Gospodarczej i Rozwoju, w szczególności do jego części (d), postanowiły, co następuje: Artykuł 1 Dla celów niniejszej umowy:

Dziennik Ustaw Nr 22 (a) „Organizacja” oznacza Organizację Współpracy Gospodarczej i Rozwoju, utworzoną na mocy Konwencji o Organizacji Współpracy Gospodarczej i Rozwoju, podpisanej w Paryżu w dniu 14 grudnia 1960 r.; (b) „Rząd” oznacza Rząd Rzeczypospolitej Polskiej; (c) „przedstawiciele” oznacza wszystkich delegatów, zastępców, doradców, ekspertów technicznych oraz sekretarzy delegacji akredytowanych przy Organizacji lub uczestniczących w spotkaniu zwołanym przez Organizację; (d) „Państwa członkowskie” oznacza państwa, które są członkami Organizacji; (e) „obserwatorzy” oznacza państwa lub międzynarodowe organizacje, które otrzymały od Organizacji zaproszenie do uczestnictwa, w charakterze obserwatora lub na innej podstawie, w spotkaniach zwołanych przez Organizację; (f) „funkcjonariusze” oznacza kategorie funkcjonariuszy, wobec których mają zastosowanie postanowienia niniejszej umowy, wymienione przez Sekretarza Generalnego i przedłożone Radzie Organizacji. Nazwiska funkcjonariuszy określonych kategorii będą co pewien czas podawane do wiadomości Rządu; (g) „spotkania zwoływane przez Organizację” oznacza wszelkie spotkania organów Organizacji i każde inne spotkanie, konferencję międzynarodową lub inne zebranie zwoływane przez Organizację; (h) „majątek Organizacji” oznacza wszelką własność Organizacji, w tym fundusze i środki trwałe należące do Organizacji lub posiadane przez nią, albo będące pod zarządem Organizacji lub posiadane albo zarządzane w jej imieniu;                — 1343 — (a) ”Organisation” means the Organisation for Economic Cooperation and Development, established by the Convention on the Organisation for Economic Cooperation and Development, signed in Paris on 14 December 1960; (b) ”Government” means the Government of the Republic of Poland; (c) ”representatives” means all delegates, alternates, advisers, technical experts and secretaries of delegations accredited to the Organisation or participating in a meeting convened by the Organisation; (d) ”Members” means states which are Members of the Organisation; (e) ”observers” means states or international organisations which have received an invitation from the Organisation to participate, as observers or on any other basis, in a meeting convened by the Organisation; (f) ”officials” means the categories of officials to which the provisions of this Agreement apply as specified by the SecretaryGeneral and submitted to the Council of the Organisation. The names of the officials included in these categories shall from time to time be made known to the Government;                Poz. 207


(a) le terme ”Organisation” désigne l’Organisation de Coopération et de Développement Economiques créée par la Convention relative ∫ l’Organisation de Coopération et de Développement Economiques signée ∫ Paris le 14 décembre 1960; (b) le terme ”gouvernement” désigne le gouvernement de la République de Pologne; (c) le terme ”représentants” désigne les délégués, délégués suppléants, conseillers, experts techniques et secrétaires de délégations accrédités aupr¯s de l’Organisation ou participant ∫ une réunion organisée par l’Organisation; (d) le terme ”Membres” désigne les Etats qui sont membres de l’Organisation; (e) le terme ”observateurs” désigne les Etats ou les organisations internationales qui ont re˜u de l’Organisation une invitation ∫ participer, en qualité d’observateur ou ∫ tout autre titre, ∫ une réunion organisée par l’Organisation; (f) le terme ”fonctionnaires” désigne les catégories de fonctionnaires auxquelles s’appliquent les dispositions du présent Accord telles qu’elles sont déterminées par le Secrétaire général et soumises au Conseil de l’Organisation. Les noms des fonctionnaires compris dans ces catégories seront communiqués périodiquement au gouvernement; (g) l’expression ”réunions organisées par l’Organisation” désigne toute réunion d’un organe de l’Organisation ainsi que toute autre réunion, conférence internationale et colloque organisés par l’Organisation; (h) l’expression ”biens de l’Organisation” désigne tous les biens, y compris les fonds et avoirs, appartenant ∫ l’Organisation ou détenus ou gérés par celle-ci ou pour son compte;

(g) ”meetings convened by the Organisation” means any meeting of a body of the Organisation, and any other meeting, international conference or other gathering convened by the Organisation; (h) ”property of the Organisation” means all property, including funds and assets, belonging to the Organisation or held or administered by the Organisation or on its behalf;

Dziennik Ustaw Nr 22 (i) „archiwa Organizacji” oznacza wszelkie akta i korespondencję, dokumenty i inne materiały, w tym taśmy i nagrania filmowe, nagrania dźwiękowe, oprogramowanie komputerowe i materiały pisane, taśmy video i dyskietki, jak również dyskietki i taśmy zawierające dane należące do Organizacji lub będące w jej posiadaniu.                — 1344 — (i) ”archives of the Organisation” means all records and correspondence, documents and other material, including tapes and films, sound recordings, computer software and written material, video tapes and discs, as well as discs and tapes containing data belonging to or held by the Organisation.                Poz. 207


(i) l’expression ”archives de l’Organisation” désigne tous les dossiers, courriers, documents et autres matériaux, y compris les bandes magnétiques et les films, les enregistrements sonores, les logiciels informatiques et les documents écrits, les bandes et disques vidéos, ainsi que les disques et les bandes magnétiques contenant des données appartenant ∫ l’Organisation, ou détenus par elle. Article 2 L’Organisation poss¯de la personnalité juridique. Elle a la capacité de contracter, d’acquérir et aliéner des biens mobiliers et immobiliers et d’ester en justice.

Artykuł 2 Organizacja posiada osobowość prawną. Ma ona zdolność do zawierania umów, nabywania i rozporządzania mieniem ruchomym i nieruchomym oraz do podejmowania czynności procesowych. Artykuł 3 Organizacja i jej majątek, gdziekolwiek się znajdujący lub przez kogokolwiek posiadany, korzystają z immunitetu jurysdykcyjnego, chyba że Organizacja w jakimś szczególnym wypadku zrzeknie się wyraźnie tego immunitetu. W każdym razie rozumie się, że zrzeczenie się immunitetu nie może rozciągać się jednocześnie na czynności egzekucyjne. Artykuł 4 Budynki i pomieszczenia Organizacji, w tym pomieszczenia, z których korzysta Organizacja w czasie spotkania zwołanego przez Organizację, są nietykalne. Majątek Organizacji, gdziekolwiek i w czyichkolwiek rękach by się znajdował, nie podlega rewizji, rekwizycji, konfiskacie, wywłaszczeniu lub innym formom ingerencji spowodowanej działaniami administracyjnymi, sądowymi lub wynikającymi z ustaw.

Article 2 The Organisation shall possess juridical personality. It shall have the capacity to conclude contracts, to acquire and dispose of movable and immovable property and to institute legal proceedings. Article 3 The Organisation and its property, wherever located and by whomsoever held, shall enjoy immunity from every form of legal process except insofar as in any particular case it has expressly waived its immunity. It is, however, understood that no waiver of immunity shall extend to any measure of execution.

Article 3 L’Organisation et ses biens, où qu’ils se trouvent et quel que soit leur détenteur, jouissent de l’immunité de juridiction, sauf dans la mesure où l’Organisation y a expressément renoncé dans un cas particulier. Il est toutefois entendu que la renonciation ne peut s’étendre ∫ des mesures d’exécution.

Article 4 Article 4 The premises of the Organisation, including premises utilised by the Organisation for the duration of a meeting convened by the Organisation, shall be inviolable. The property of the Organisation, wherever and by whomsoever held, shall be immune from search, requisition, confiscation, expropriation or any other form of interference whether by administrative, judicial or legislative action. Les locaux de l’Organisation, y compris ceux utilisés par l’Organisation pour la durée d’une réunion organisée par celle-ci, sont inviolables. Les biens de l’Organisation, où qu’ils se trouvent et quel que soit leur détenteur, sont exempts de perquisition, réquisition, confiscation, expropriation ou de toute autre forme de contrainte administrative, judiciaire ou législative.

Artykuł 5 Archiwa Organizacji i wszelkie inne dokumenty należące do niej lub będące w jej posiadaniu są nietykalne bez względu na miejsce, gdzie się znajdują.

Article 5 The archives of the Organisation, and all other documents belonging to it or held by it, shall be inviolable wherever located.

Article 5 Les archives de l’Organisation et tous autres documents lui appartenant ou détenus par elle, sont inviolables où qu’ils se trouvent.

Dziennik Ustaw Nr 22 Artykuł 6 Nie podlegając żadnej kontroli finansowej, reglamentacji ani moratorium finansowemu: (a) Organizacja może posiadać dowolne środki pieniężne i prowadzić rachunki w dowolnej walucie, (b) Organizacja może swobodnie przekazywać swoje środki pieniężne w Polsce, z Polski i do Polski oraz dokonywać wymiany dowolnej waluty będącej w jej posiadaniu na dowolną inną walutę na takich samych warunkach, jakie są przewidziane dla przedstawicielstw dyplomatycznych. Artykuł 7 Organizacja i jej majątek są zwolnione z: (a) wszelkich podatków bezpośrednich. Rozumie się jednak, że Organizacja nie będzie domagała się zwolnienia z opłat ani podatków, które w istocie sprowadzają się do opłat za świadczenia usług użyteczności publicznej; (b) opłat celnych oraz zakazu i ograniczeń przywozu i wywozu, jeśli chodzi o przedmioty wwożone albo wywożone przez Organizację do użytku służbowego. Rozumie się jednak, że przedmioty wwiezione na podstawie takich zwolnień nie będą sprzedane w Polsce, chyba że nastąpi to na warunkach zatwierdzonych przez Rząd; (c) opłat celnych, wszelkich zakazów i ograniczeń przywozu i wywozu dotyczących jej wydawnictw; (d) podatków pośrednich, włącznie z podatkiem, który wchodzi w cenę towarów lub usług na takich samych warunkach, jakie są stosowane w odniesieniu do przedstawicielstw dyplomatycznych w Polsce. Artykuł 8 Na terytorium Polski Organizacja w odniesieniu do sposobów po                — 1345 — Article 6 Without being restricted by financial controls, regulations or moratoria of any kind: (a) the Organisation may hold currency of any kind and operate accounts in any currency; (b) the Organisation may freely transfer its funds within, into and out of Poland and convert any currency held by it into any other currency under the same conditions as provided for diplomatic missions. Sans ˘tre astreinte ∫ aucun contrôle, réglementation ou moratoire financiers: (a) l’Organisation peut détenir des devises quelconques et avoir des comptes en n’importe quelle monnaie; (b) l’Organisation peut transférer librement ses fonds ∫ l’intérieur de la Pologne, ainsi que vers ou depuis celle-ci et convertir toutes devises détenues par elle en toute autre monnaie dans les m˘mes conditions que celles qui sont accordées aux missions diplomatiques. Article 7 L’Organisation et ses biens sont exemptés: (a) de tout impôt direct; toutefois l’Organisation ne demandera pas l’exonération de droits et de taxes qui ne constituent que la simple rémunération de services d’utilité publique;

Article 7 The Organisation and its property shall be exempt from: (a) any form of direct taxation. It is understood however that the Organisation will not claim exemption from rates and taxes which are in fact no more than a payment for public utility services; (b) customs duties, prohibitions or restrictions on imports and exports in respect of articles imported or exported by the Organisation for its official use. It is understood, however, that the articles imported under such exemptions will not be sold in Poland except under conditions approved by the Government; (c) customs duties, restrictions and prohibitions on imports and exports in respect of its publications; (d) indirect taxes, including taxes forming part of the price to be paid for goods or services, under the same conditions as applied with respect to diplomatic missions in Poland. Article 8 The Organisation shall enjoy in the territory of Poland, for its offi-

Article 8 L’Organisation bénéficiera, sur le territoire polonais, d’un traite-

Dziennik Ustaw Nr 22 rozumiewania się będzie korzystała z traktowania co najmniej tak przychylnego, jak traktowanie przyznane w Polsce każdemu rządowi, włączając w to jego misję dyplomatyczną lub inną organizację międzynarodową. Dotyczy to pierwszeństwa obsługi, stawek i podatków odnoszących się do przesyłek, depesz, telegramów, radiogramów, zdjęć przekazywanych na odległość, telefaksów, rozmów telefonicznych i innych środków porozumiewania się, a także stawek prasowych za informacje dla prasy i radia. Oficjalna korespondencja oraz inne oficjalne informacje przekazywane przez Organizację nie będą podlegały żadnej cenzurze. Artykuł 9 W celu umożliwienia Organizacji pełnego i skutecznego wykonywania jej obowiązków i wypełniania zadań: (a) Rząd podejmie wszelkie stosowne kroki w celu ułatwienia wjazdu, pobytu i opuszczenia terytorium Polski, jak również swobody poruszania się na terytorium Polski przedstawicielom Państw członkowskich, przedstawicielom obserwatorów, funkcjonariuszom i ekspertom Organizacji oraz wszystkim innym osobom zaproszonym przez Organizację w celach urzędowych; (b) podstawowe świadczenia publiczne zostaną udostępnione Organizacji na takich samych zasadach jak przedstawicielstwom dyplomatycznym. Artykuł 10

1. Przedstawiciele Państw członkowskich i obserwatorów w czasie wykonywania swych funkcji oraz w czasie ich podróży do i z miejsca spotkań korzystają z przywilejów, immunitetów i ułatwień, z których zazwyczaj korzystają przedstawiciele dyplomatyczni o porównywalnej randze.

2. W celu zapewnienia przedstawicielom Państw członkowskich i obserwatorów przy organach Organizacji oraz na spotkania zwoływane przez Organizację pełnej wol                — 1346 — cial communications, treatment not less favourable than that accorded by Poland to any government, including its diplomatic mission, or any other international organisation, in the matter of priorities, rates and taxes on mails, cables, telegrams, radiograms, telephotos, telefaxes, telephone and other communications and press rates for information to the press and radio. La correspondance officielle et les autres communications officielles de l’Organisation ne pourront ˘tre censurées. Article 9 Afin de permettre ∫ l’Organisation de s’acquitter enti¯rement et efficacement de ses responsabilités et de ses tâches: (a) le gouvernement prendra toutes les mesures requises pour faciliter l’entrée, le séjour sur le territoire polonais et la sortie de ce territoire ainsi que la liberté de mouvement sur le territoire polonais des représentants des Membres, des représentants des observateurs, des fonctionnaires et des experts de l’Organisation ou de toute autre personne invitée par celle-ci ∫ des fins officielles; (b) les services publics essentiels seront mis ∫ la disposition de l’Organisation sur les m˘mes bases que pour les missions diplomatiques. Article 10

1. Les représentants des Membres et des observateurs jouissent, durant l’exercice de leurs fonctions et au cours des voyages ∫ destination ou en provenance du lieu de la réunion des privil¯ges, immunités et facilités dont jouissent normalement les agents diplomatiques de rang comparable.

2. Afin de garantir aux représentants des Membres et des observateurs aux organes de l’Organisation et aux réunions organisées par celle-ci, une compl¯te li-

Article 9 In order to enable the Organisation to fully and efficiently discharge its responsibilities and fulfill its tasks: (a) the Government shall take all appropriate measures for the purpose of facilitating entry to, staying in, and exit from the territory of Poland, as well as freedom of movement within the territory of Poland, of representatives of Members, representatives of observers, officials and experts of the Organisation or any other person invited by the Organisation for official purposes; (b) essential public services shall be made available to the Organisation on the same basis as to diplomatic missions.

Article 10

1. Representatives of Members and of observers shall, while exercising their functions and during their journey to and from the place of meeting, enjoy the privileges, immunities and facilities normally enjoyed by diplomatic envoys of comparable rank.

2. In order to secure for representatives of Members and of observers to the bodies of the Organisation and to meetings convened by the Organisation, complete fre-

Dziennik Ustaw Nr 22 ności słowa i swobody w wykonywaniu ich obowiązków zostanie im przyznany immunitet niepodlegania postępowaniu sądowemu odnośnie do wszelkich wypowiedzi ustnych czy pisemnych oraz wszelkich działań dokonanych przez nich w trakcie pełnienia obowiązków. Immunitet ten trwa nadal bez względu na to, że dane osoby mogą już nie być przedstawicielami Państw członkowskich lub obserwatorów.

3. Każdy przedstawiciel posiadający obywatelstwo polskie korzysta z przywilejów, immunitetów i ułatwień wymienionych w ustępach 1 i 2 jedynie w odniesieniu do czynności urzędowych przy wykonywaniu swoich obowiązków. Artykuł 11

1. Funkcjonariusze Organizacji będą: (a) korzystać z immunitetu w zakresie postępowania sądowego w odniesieniu do czynności dokonanych przez nich podczas pełnienia funkcji; immunitet ten będzie nadal obowiązywać po zakończeniu pełnienia obowiązków w charakterze funkcjonariusza Organizacji; (b) zwolnieni od wszelkich podatków bezpośrednich od pensji, wynagrodzeń i rekompensat wypłacanych im przez Organizację; (c) zwolnieni ze stosowania wobec nich, ich współmałżonków i członków rodziny będących na ich utrzymaniu ograniczeń imigracyjnych oraz wymogów odnośnie do rejestracji cudzoziemców; (d) korzystać z takich samych przywilejów w dziedzinie ułatwień przy wymianie dewiz, z jakich korzystają porównywalni rangą przedstawiciele dyplomatyczni akredytowani w Polsce; (e) korzystać, zarówno sami, jak i ich współmałżonkowie i członkowie rodziny, będący na ich utrzymaniu, z takich samych ułatwień przy powrocie do kraju w czasie kryzysu międzynarodowego, jakie przysługują członkom misji dyplomatycznych;                — 1347 — edom of speech and independence in the discharge of their duties, the immunity from legal process in respect of words spoken or written and all acts done by them in discharging their duties shall continue to be accorded, notwithstanding that the persons concerned are no longer the representatives of Members or of observers.                Poz. 207

3. Any representative having Polish citizenship shall enjoy the privileges, immunities and facilities specified in paragraphs 1 and 2 only with respect to official acts performed in the discharge of his or her duties. Article 11

1. Officials of the Organisation shall: (a) be immune from legal process in respect of things done by them in their official capacity; they shall continue to be so immune after completion of their functions as officials of the Organisation; (b) be exempt from any form of direct taxation on salaries, emoluments and indemnities paid to them by the Organisation; (c) be exempt, together with their spouses and dependent relatives, from immigration restrictions and alien registration;

3. Les représentants de nationalité polonaise ne jouiront des privil¯ges, immunités et facilités énoncés aux paragraphes 1 et 2 que pour les actes officiels accomplis dans l’exercice de leurs fonctions. Article 11

1. Les fonctionnaires de l’Organisation: (a) jouissent de l’immunité de juridiction pour les actes accomplis par eux en leur qualité officielle; ils continueront ∫ bénéficier de cette immunité apr¯s la cessation de leurs fonctions; (b) sont exonérés de tout type d’impôt direct sur les salaires, émoluments et indemnités versés par l’Organisation; (c) ne sont pas soumis, non plus que leur conjoint et les membres de leur famille vivant ∫ leur charge, aux dispositions limitant l’immigration et aux formalités d’enregistrement des étranges; (d) jouissent, en ce qui concerne les facilités de change, des m˘mes privil¯ges que les agents diplomatiques d’un rang comparable accrédités en Pologne; (e) jouissent, ainsi que leur conjoint et les membres de leur famille vivant ∫ leur charge, des m˘mes facilités de rapatriement que les membres des missions diplomatiques en période de crise internationale;

(d) be accorded the same privileges in respect of exchange facilities as are accorded to the diplomatic agents of comparable rank accredited in Poland; (e) be given, together with their spouses and dependent relatives, the same repatriation facilities in cases of international crisis as members of diplomatic missions;

2. Le Secrétaire général de l’Organisation, son conjoint et ses enfants âgés de moins de 21 ans, jouissent des privil¯ges, immunités et avantages accordés aux chefs de missions diplomatiques. Les Secrétaires généraux adjoints et suppléants, leur conjoint et leurs enfants âgés de moins de 21 ans jouissent des privil¯ges, immunités et avantages accordés aux représentants diplomatiques accrédités en Pologne.

3. Le Secrétaire général de l’Organisation informe le Minist¯re des affaires étrang¯res de la République de Pologne des noms et prénoms des personnes auxquelles s’appliquent les dispositions du présent article.

4. Les dispositions du paragraphe 1 (c), (d), (e) et (f) du présent article ne s’appliquent pas aux personnes qui résidaient ∫ titre permanent en Pologne immédiatement avant d’˘tre employées par l’Organisation. Article 12

1. Les experts en mission pour l’Organisation jouissent, pendant la durée de cette mission, y compris le temps des voyages liés ∫ la mission, des privil¯ges, immunités et facilités nécessaires pour qu’ils puissent exercer leurs fonctions en toute indépendance, notamment: (a) de l’immunité d’arrestation personnelle ou de détention et de saisie de leurs bagages personnels; (b) de l’immunité de juridiction pour leurs discours ou écrits et pour les actes accomplis par eux au cours de leur mission; ils continueront ∫ bénéficier de

2. Sekretarz Generalny Organizacji, jego/jej małżonka/małżonek i dzieci w wieku do 21 lat będą korzystać z przywilejów, immunitetów i ułatwień takich samych jak szefowie misji dyplomatycznych. Zastępcy Sekretarza Generalnego i Pomocniczy Sekretarze Generalni, ich małżonkowie i ich dzieci w wieku do 21 lat będą korzystać z przywilejów, immunitetów i ułatwień, jakie posiadają przedstawiciele dyplomatyczni akredytowani w Polsce.

3. Sekretarz Generalny Organizacji poinformuje Ministerstwo Spraw Zagranicznych Rzeczypospolitej Polskiej o pełnych nazwiskach osób, w stosunku do których znajdują zastosowanie postanowienia niniejszego artykułu.

4. Postanowienia ustępu 1 punkty (c), (d), (e) i (f) niniejszego artykułu nie mają zastosowania do osób zamieszkałych na stałe w Polsce w czasie bezpośrednio poprzedzającym ich zatrudnienie w Organizacji. Artykuł 12

1. Ekspertom wykonującym zadania na zlecenie Organizacji będą przysługiwać przywileje, immunitety i ułatwienia niezbędne do należytego wykonywania ich funkcji na czas wykonywania zadań, licząc w tym również czas podróży związany z ich zadaniami. W szczególności będą oni korzystać z: (a) immunitetu od tymczasowego aresztowania lub zatrzymania oraz zajęcia ich bagażu osobistego; (b) immunitetu w zakresie postępowania sądowego w odniesieniu do wypowiedzi ustnych lub pisemnych oraz działań dokonanych przez nich w trak-

2. The Secretary-General of the Organisation, his/her spouse and children under the age of 21, shall enjoy the privileges, immunities and benefits granted to the heads of diplomatic missions. The Deputy and Assistant Secretaries-General, their spouses and children under the age of 21, shall enjoy privileges, immunities and benefits accorded to diplomatic representatives accredited in Poland.

3. The Secretary-General of the Organisation shall inform the Ministry of Foreign Affairs of the Republic of Poland of the full names of the persons to whom the provisions of this article apply.

4. The provisions of paragraph 1 (c), (d), (e) and (f) of this article shall not apply to persons permanently residing in Poland immediately prior to their employment with the Organisation. Article 12

1. Experts performing missions for the Organisation shall enjoy such privileges, immunities and facilities as are necessary for the independent exercise of their functions during the period of their missions, including time spent on journeys in connection with their missions. In particular they shall enjoy: (a) immunity from arrest or detention and from seizure of their personal baggage; (b) immunity from legal process of every kind in respect of words spoken or written and acts done by them in the course of the performance of their

Dziennik Ustaw Nr 22 cie pełnienia zadań; zwolnienie to będzie nadal obowiązywać po wykonaniu zadań; (c) nietykalności ich akt i dokumentów; (d) prawa do używania szyfrów oraz wysyłania i otrzymywania korespondencji i innych akt i dokumentów dla celów utrzymywania łączności z Organizacją; (e) tych samych ułatwień odnoszących się do ograniczeń dewizowych i wymiany, które przysługują członkom misji dyplomatycznych; (f) tych samych immunitetów i ułatwień w stosunku do ich bagażu osobistego, z jakich korzystają przedstawiciele dyplomatyczni.

2. Sekretarz Generalny Organizacji poinformuje Ministerstwo Spraw Zagranicznych Rzeczypospolitej Polskiej o pełnych nazwiskach osób, w stosunku do których postanowienia niniejszego artykułu znajdą zastosowanie.

3. Postanowienia ustępu 1 punkty (a), (e) i (f) niniejszego artykułu nie mają zastosowania do osób zamieszkałych na stałe w Polsce w czasie bezpośrednio poprzedzającym ich zatrudnienie w Organizacji. Artykuł 13

1. Przywileje i immunitety przyznawane osobom wymienionym w artykułach 10, 11 i 12 niniejszej umowy przyznawane są wyłącznie w interesie Organizacji, a nie dla ich osobistej korzyści.                — 1349 — mission; such immunity shall continue after the completion of their mission; (c) inviolability for their papers and documents; (d) the right, for the purpose of communicating with the Organisation, to use codes and to send and receive correspondence and other papers and documents; (e) the same facilities with respect to currency and exchange restrictions as are accorded to members of diplomatic missions; (f) the same immunities and facilities in respect of their personal baggage as are accorded to diplomatic envoys.

2. The SecretaryGeneral of the Organisation shall inform the Ministry of Foreign Affairs of the Republic of Poland of the full names of the persons to whom the provisions of this article apply.

3. The provisions of paragraph 1(a), (e) and (f) of this article shall not apply to persons permanently residing in Poland immediately prior to their appointment by the Organisation. Article 13

1. The privileges and immunities accorded to the persons referred to in Articles 10, 11 and 12 of the present Agreement are granted exclusively in the interests of the Organisation and not for the personal benefit of the individuals concerned.

2. A Member or an observer has not only the right but the duty to waive the immunity of its representative in any case where, in its opinion, the immunity would impede the course of justice and it can be waived without prejudice to the purpose for which the immunity is accorded.

4. W przypadku Sekretarza Generalnego, jego Zastępców i Pomocniczych Sekretarzy Generalnych Organizacji prawo uchylenia immunitetu ma Rada Organizacji. Artykuł 14 Organizacja współpracuje w każdym czasie z władzami polskimi w celu ułatwienia działalności wymiaru sprawiedliwości i zapobiegania wszelkim nadużyciom prawa, które mogą wystąpić w związku z przywilejami, immunitetami, zwolnieniami i ułatwieniami wymienionymi w niniejszej umowie. Artykuł 15

1. W przypadku powstania sporu pomiędzy Umawiającymi się Stronami co do interpretacji lub stosowania niniejszej umowy będą one dążyły do znalezienia rozwiązania na drodze konsultacji, negocjacji, koncyliacji lub w inny wzajemnie uzgodniony sposób.

2. Jeżeli spór nie zostanie rozwiązany zgodnie z ustępem 1 w ciągu sześćdziesięciu dni od wystosowania przez którąkolwiek ze stron wniosku o jego rozstrzygnięcie lub po wyczerpaniu wspólnie uzgodnionej procedury, każda ze stron może go skierować do arbitrażu.                — 1350 — and duty to waive the immunity of any official or expert where, in his/her opinion, the immunity of this official or expert would impede the course of justice and it can be waived without prejudice to the interests of the Organisation.

4. In the case of the SecretaryGeneral and the Deputy and Assistant SecretariesGeneral of the Organisation, the Council of the Organisation shall have the right to waive immunity. Article 14 The Organisation shall cooperate at all times with the Polish authorities to facilitate the proper administration of justice and prevent the occurrence of any abuse of law which might arise in connection with the privileges, immunities, exemptions and facilities mentioned in this Agreement. 1. In the case of a dispute between the Contracting Parties as to the interpretation or application of this Agreement, they shall seek a solution by consultations, negotiations, conciliation or by some other mutually agreed method.                Poz. 207

Article 14 L’Organisation collaborera, en tous temps avec les autorités polonaises pour faciliter la bonne administration de la justice et éviter tout abus auquel pourraient donner lieu les privil¯ges, immunités, exemptions et facilités mentionnés dans le présent Accord. Article 15

1. En cas de différend entre les Parties contractantes concernant l’interprétation ou l’application du présent Accord, celles-ci chercheront une solution par voie de consultations, de négociations, de conciliation ou par quelque autre méthode convenue d’un commun accord.

2. Si le différend n’est pas réglé conformément au paragraphe 1 dans un délai de soixante jours ∫ compter de la date ∫ laquelle l’une ou l’autre des parties a demandé qu’il soit réglé ou apr¯s l’épuisement d’une procédure de r¯glement convenue par consentement mutuel, il est soumis ∫ arbitrage ∫ la demande de l’une ou l’autre partie.

3. Le tribunal arbitral est composé de trois arbitres: l’un choisi par le gouvernement, le second par l’Organisation et le troisi¯me, qui sera le président du tribunal, choisi conjointement par les Parties contractantes. Si le tribunal n’est pas constitué dans un délai de trois mois ∫ compter de la demande d’arbitrage, les arbitres non encore désignés sont nommés par le président de la Cour internationale de justice, ∫ la demande de l’une ou l’autre partie. Artykuł 16 W przypadku gdy Rząd przyzna bardziej korzystne przywileje, zwolnienia lub immunitety dla podobnego rodzaju organizacji międzynarodowej, to będzie on dążył do przyznania Organizacji podobnego traktowania. Artykuł 17 Niniejsza umowa wejdzie w życie w dniu, kiedy Rząd poinformuje Organizację o spełnieniu wymogów wewnętrznych dla jej przyjęcia. Artykuł 18 Przed przystąpieniem Polski do Konwencji Organizacji Współpracy Gospodarczej i Rozwoju niniejsza umowa może być wypowiedziana przez każdą z Umawiających się Stron po uprzednim sześciomiesięcznym notyfikowaniu drugiej Umawiającej się Stronie takiego zamiaru. Artykuł 19 Niniejsza umowa będzie stosowana tymczasowo od dnia jej podpisania do czasu jej wejścia w życie, w takim zakresie, na jaki zezwala prawo wewnętrzne Rzeczypospolitej Polskiej. Sporządzono w Paryżu dnia 16 stycznia tysiąc dziewięćset dziewięćdziesiątego piątego roku, w dwóch egzemplarzach w językach polskim, angielskim i francuskim.
