KONWENCJA o prawie właściwym dla wypadków drogowych, sporządzona w Hadze dnia 4 maja 1971 r. W imieniu Rzeczypospolitej Polskiej PREZYDENT RZECZYPOSPOLITEJ POLSKIEJ podaje do powszechnej wiadomości: W dniu 4 maja 1971 r. została sporządzona w Hadze Konwencja o prawie właściwym dla wypadków drogowych, w następującym brzmieniu: Przekład KONWENCJA o prawie właściwym dla wypadków drogowych, sporządzona 4 maja 1971 r. Państwa-Sygnatariusze niniejszej konwencji, pragnąc ustanowić wspólne przepisy o prawie właściwym dla pozaumownej odpowiedzialności cywilnej wynikającej z wypadków drogowych, postanowiły w tym celu zawrzeć konwencję i uzgodniły następujące postanowienia: Artykuł 1 Niniejsza konwencja określa prawo właściwe dla pozaumownej odpowiedzialności cywilnej wynikającej z wypadków drogowych, niezależnie od rodzaju postępowania, w którym dochodzi się tej odpowiedzialności.

W rozumieniu niniejszej konwencji za wypadek drogowy uważa się wypadek, w którym uczestniczy jeden lub kilka pojazdów z napędem silnikowym lub bez napędu, wiążący się z ruchem na drodze publicznej, na terenie ogólnodostępnym lub na terenie prywatnym dostępnym dla niektórych osób. Artykuł 2 Niniejszej konwencji nie stosuje się do:

1) odpowiedzialności producentów, sprzedawców i naprawiających pojazdy;

2) odpowiedzialności właściciela lub innej osoby odpowiedzialnej za utrzymanie drogi otwartej dla ruchu lub za bezpieczeństwo jej użytkowników;

3) odpowiedzialności za cudze czyny, z wyjątkiem odpowiedzialności właściciela lub posiadacza pojazdu;

4) roszczeń regresowych pomiędzy osobami ponoszącymi odpowiedzialność;

5) roszczeń regresowych i subrogacji towarzystw ubezpieczeniowych;

6) roszczeń oraz roszczeń regresowych instytucji ubezpieczeń społecznych lub roszczeń przeciwko takim instytucjom; takich roszczeń innych podobnych instytucji i publicznych samochodowych funduszy gwarancyjnych oraz zwolnienia od odpowiedzialności przewidzianego przez prawo, któremu podlegają te instytucje. Artykuł 3 Prawem właściwym jest prawo wewnętrzne państwa, w którym nastąpił wypadek. Artykuł 4 Z zastrzeżeniem artykułu 5 przyjmuje się następujące wyjątki od postanowień artykułu 3: a) jeżeli w wypadku uczestniczy tylko jeden pojazd, który jest zarejestrowany w państwie innym niż to, w którym nastąpił wypadek, do odpowiedzialności stosuje się prawo wewnętrzne państwa rejestracji: — wobec kierowcy, posiadacza, właściciela i innej osoby mającej prawo do pojazdu, niezależnie od jej miejsca stałego pobytu, — wobec ofiary będącej pasażerem, jeżeli jej miejscem stałego pobytu jest państwo inne niż to, w którym nastąpił wypadek, — wobec ofiary znajdującej się poza pojazdem na miejscu wypadku, jeżeli miała miejsce stałego pobytu w państwie rejestracji. Jeżeli jest wiele ofiar, określa się prawo właściwe oddzielnie dla każdej z nich. b) jeżeli w wypadku uczestniczy wiele pojazdów, postanowienia litery a) stosuje się tylko wówczas,

gdy wszystkie pojazdy są zarejestrowane w tym samym państwie. c) jeżeli w wypadku uczestniczy wiele osób znajdujących się poza pojazdem lub pojazdami na miejscu wypadku i mogą być one odpowiedzialne, postanowienia liter a) oraz b) stosuje się tylko wówczas, gdy wszystkie te osoby mają miejsca stałego pobytu w państwie rejestracji; to samo stosuje się, jeżeli osoby te są również ofiarami wypadku. Artykuł 5 Prawu właściwemu na podstawie artykułów 3 oraz 4 dla odpowiedzialności wobec pasażera będącego ofiarą podlega odpowiedzialność za uszkodzenie rzeczy przewożonych w pojeździe, należących do pasażera lub powierzonych pasażerowi. Prawu właściwemu na podstawie artykułów 3 oraz 4 dla odpowiedzialności wobec właściciela pojazdu podlega odpowiedzialność za uszkodzenie rzeczy przewożonych w pojeździe, innych niż rzeczy wymienione w ustępie poprzedzającym. Odpowiedzialność za uszkodzenie rzeczy znajdujących się poza pojazdem lub pojazdami podlega prawu wewnętrznemu państwa, w którym nastąpił wypadek. Jednakże odpowiedzialność za uszkodzenie rzeczy osobistego użytku ofiary znajdującej się poza pojazdem lub pojazdami podlega prawu wewnętrznemu państwa rejestracji, jeżeli prawo do byłoby właściwe do odpowiedzialności wobec ofiary zgodnie z artykułem

4. Artykuł 6 Odnośnie do pojazdów niezarejestrowanych lub zarejestrowanych w kilku państwach prawo wewnętrzne państwa, w którym pojazdy te stale stacjonują, zastępuje prawo państwa rejestracji. To samo stosuje się, jeżeli ani właściciel, ani posiadacz, ani kierowca pojazdu nie mają w czasie wypadku miejsca stałego pobytu w państwie rejestracji. Artykuł 7 Niezależnie od prawa właściwego przy określaniu odpowiedzialności bierze się pod uwagę przepisy o bezpieczeństwie ruchu na drogach obowiązujące w miejscu i czasie wypadku. Artykuł 8 Prawo właściwe określa w szczególności:

1) przesłanki i zakres odpowiedzialności;

2) podstawy zwolnienia od odpowiedzialności, ograniczenie odpowiedzialności oraz podział odpowiedzialności;

3) istnienie oraz rodzaj obrażeń ciała lub szkody, za które należy się odszkodowanie;

4) rodzaj oraz zakres szkód;

5) cesję i dziedziczenie prawa do odszkodowania;

6) osoby poszkodowane i uprawnione do odszkodowania;

7) odpowiedzialność przełożonego za czyny podwładnego oraz pracodawcy za czyny pracownika;

8) przedawnienie i prekluzję, łącznie z zasadami dotyczącymi początku biegu przedawnienia lub prekluzji, oraz przerwy lub zawieszenia biegu. Artykuł 9 Osoby, które doznały obrażeń ciała lub szkody, mają prawo do wystąpienia z roszczeniem bezpośrednio do ubezpieczyciela osoby odpowiedzialnej, jeżeli takie uprawnienie przyznaje im prawo właściwe na podstawie artykułów 3, 4 lub

5. Jeżeli prawo państwa rejestracji właściwe na podstawie artykułów 4 lub 5 nie przewiduje takiego uprawnienia, można z niego korzystać, jeżeli jest przewidziane przez prawo wewnętrzne państwa, w którym nastąpił wypadek. Jeżeli żadne z tych praw nie przewiduje takiego uprawnienia, można z niego korzystać, jeżeli jest przewidziane przez prawo, któremu podlega umowa ubezpieczenia. Artykuł 10 Stosowania jakiegokolwiek prawa właściwego na podstawie niniejszej konwencji można odmówić tylko wówczas, gdy jest ono oczywiście sprzeczne z porządkiem publicznym. Artykuł 11 Artykuły od 1 do 10 niniejszej konwencji stosuje się niezależnie od jakiegokolwiek warunku wzajemności. Konwencję stosuje się nawet wówczas, gdy prawo właściwe nie jest prawem Umawiającego się Państwa. Artykuł 12 Każdą jednostkę terytorialną stanowiącą część państwa niemającego jednolitego systemu prawnego uważa się za państwo przy stosowaniu artykułów od 2 do 11, jeżeli ma swój własny system prawny pozaumownej odpowiedzialności za wypadki drogowe. Artykuł 13 Państwo niemające jednolitego systemu prawnego nie jest zobowiązane do stosowania niniejszej konwencji do wypadków, które nastąpiły w tym państwie, dotyczących jedynie pojazdów zarejestrowanych w jednostkach terytorialnych tego państwa. Artykuł 14 Państwo niemające jednolitego systemu prawnego może w czasie podpisania, ratyfikacji lub przystą-

pienia oświadczyć, że niniejszą konwencję stosuje się do wszystkich jego systemów prawnych, tylko do jednego lub kilku z nich, oraz może zmienić swe oświadczenie w każdym czasie później przez złożenie nowego. Oświadczenia powyższe będą przekazywane Ministerstwu Spraw Zagranicznych Królestwa Niderlandów z wyraźnym wskazaniem systemów prawnych, do których konwencja ma zastosowanie. Artykuł 15 Niniejszej konwencji nie przysługuje pierwszeństwo przed innymi konwencjami dotyczącymi specjalnych dziedzin, których Umawiające się Państwa są lub staną się stronami zawierającymi postanowienia dotyczące cywilnej pozaumownej odpowiedzialności za wypadki drogowe. Artykuł 16 Niniejsza konwencja jest otwarta do podpisu dla państw reprezentowanych na Jedenastej Sesji Haskiej Konferencji Prawa Prywatnego Międzynarodowego. Podlega ona ratyfikacji, a dokumenty ratyfikacyjne składa się w Ministerstwie Spraw Zagranicznych Królestwa Niderlandów. Artykuł 17 Niniejsza konwencja wchodzi w życie sześćdziesiątego dnia po złożeniu trzeciego dokumentu ratyfikacyjnego przewidzianego w ustępie drugim artykułu

16. Konwencja wchodzi w życie dla każdego Państwa-Sygnatariusza, które ją następnie ratyfikuje, sześćdziesiątego dnia po złożeniu przez nie dokumentu ratyfikacyjnego. Artykuł 18 Państwo niereprezentowane na Jedenastej Sesji Haskiej Konferencji Prawa Prywatnego Międzynarodowego, które jest członkiem tej Konferencji, Organizacji Narodów Zjednoczonych lub wyspecjalizowanej agencji tej Organizacji lub jest stroną Statutu Międzynarodowego Trybunału Sprawiedliwości, może przystąpić do niniejszej konwencji po jej wejściu w życie zgodnie z ustępem pierwszym artykułu

17. Dokument przystąpienia składa się w Ministerstwie Spraw Zagranicznych Królestwa Niderlandów. Konwencja wejdzie w życie w stosunku do państwa przystępującego do niej sześćdziesiątego dnia po złożeniu przez nie dokumentu przystąpienia. Przystąpienie staje się skuteczne tylko w stosunkach między państwem przystępującym a tymi Umawiającymi się Państwami, które złożą oświadczenie o przyjęciu przystąpienia. Oświadczenie takie składa się w Ministerstwie Spraw Zagranicznych Królestwa Niderlandów, które

przekaże jego uwierzytelniony odpis każdemu Umawiającemu się Państwu drogą dyplomatyczną. Konwencja wchodzi w życie pomiędzy państwem przystępującym a państwem, które złożyło oświadczenie, sześćdziesiątego dnia po złożeniu oświadczenia o przyjęciu. Artykuł 19 Państwo może w czasie podpisania, ratyfikacji lub przystąpienia oświadczyć, że niniejszą konwencję stosuje się do wszystkich terytoriów, które reprezentuje w stosunkach międzynarodowych, lub do jednego albo kilku z tych terytoriów. Oświadczenie takie staje się skuteczne od chwili wejścia w życie konwencji w stosunku do tego państwa. W późniejszym czasie o takim rozszerzeniu zakresu stosowania konwencji zawiadamia się Ministerstwo Spraw Zagranicznych Królestwa Niderlandów. Konwencja wchodzi w życie dla terytoriów wymienionych w oświadczeniu o rozszerzeniu zakresu stosowania sześćdziesiątego dnia po zawiadomieniu określonym w ustępie poprzedzającym. Artykuł 20 Niniejsza konwencja będzie obowiązywała przez pięć lat od daty jej wejścia w życie zgodnie z ustępem pierwszym artykułu 17, również dla państw, które później ją ratyfikowały lub do niej przystąpiły. W braku wypowiedzenia konwencja ulega milcząco przedłużeniu na kolejne pięć lat. O wypowiedzeniu zawiadamia się Ministerstwo Spraw Zagranicznych Królestwa Niderlandów co najmniej na sześć miesięcy przed upływem okresu pięcioletniego.

Wypowiedzenie może ograniczać się do niektórych terytoriów, do których konwencja ma zastosowanie. Wypowiedzenie staje się skuteczne tylko w stosunku do państwa, które je złożyło. Konwencja pozostaje w mocy w stosunku do innych Umawiających się Państw. Artykuł 21 Ministerstwo Spraw Zagranicznych Królestwa Niderlandów powiadomi państwa, o których mowa w artykule 16, oraz państwa, które przystąpiły do konwencji zgodnie z artykułem 18, o: a) podpisaniach i ratyfikacjach, o których mowa w artykule 16, b) dniu wejścia w życie niniejszej konwencji zgodnie z ustępem pierwszym artykułu 17, c) przystąpieniach, o których mowa w artykule 18, i dniu, w którym stają się one skuteczne, d) oświadczeniach, o których mowa w artykułach 14 i 19, e) wypowiedzeniach, o których mowa w ustępie trzecim artykułu

20. Na dowód czego niżej podpisani, należycie w tym celu upełnomocnieni, podpisali niniejszą konwencję. Sporządzono w Hadze dnia 4 maja 1971 r. w jednym egzemplarzu w językach angielskim i francuskim, przy czym oba teksty są jednakowo autentyczne, który składa się w archiwach Rządu Królestwa Niderlandów i którego uwierzytelnioną kopię przesyła się drogą dyplomatyczną każdemu państwu reprezentowanemu na Jedenastej Sesji Haskiej Konferencji Prawa Prywatnego Międzynarodowego.

CONVENTION ON THE LAW APPLICABLE TO TRAFFIC ACCIDENTS (Concluded May 4,

1971) The States signatory to the present Convention, Desiring to establish common provisions on the law applicable to civil non-contractual liability arising from traffic accidents, Have resolved to conclude a Convention to this effect and have agreed upon the following provisions: Article 1 The present Convention shall determine the law applicable to civil non-contractual liability arising from traffic accidents, in whatever kind of proceeding it is sought to enforce this liability. For the purpose of this Convention, a traffic accident shall mean an accident which involves one or more vehicles, whether motorized or not, and is connected with traffic on the public highway, in grounds open to the public or in private grounds to which certain persons have a right of access. Article 2 The present Convention shall not apply: (1) to the liability of manufacturers, sellers or repairers of vehicles; (2) to the responsibility of the owner, or of any other person, for the maintenance of a way open to traffic or for the safety of its users; (3) to vicarious liability, with the exception of the liability of an owner of a vehicle, or of a principal, or of a master;

(5) to recourse actions and to subrogation in so far as insurance companies are concerned; (6) to actions and recourse actions by or against social insurance institutions, other similar institutions and public automobile guarantee funds, and to any exemption from liability laid down by the law which governs these institutions. Article 3 The applicable law is the internal law of the State where the accident occurred. Article 4 Subject to Article 5, the following exceptions are made to the provision of Article 3: a) Where only one vehicle is involved in the accident and it is registered in a State other than that where the accident occurred, the internal law of the State of registration is applicable to determine liability — towards the driver, owner or any other person having control of or an interest in the vehicle, irrespective of their habitual residence, — towards a victim who is a passenger and whose habitual residence is in a State other than that where the accident occurred, — towards a victim who is outside the vehicle at the place of the accident and whose habitual residence is in the State of registration. Where there are two or more victims the applicable law is determined separately for each of them. b) Where two or more vehicles are involved in the accident, the provisions of a) are applicable only if all the vehicles are registered in the same State. c) Where one or more persons outside the vehicle or vehicles at the place of the accident are involved in the accident and may be liable, the provisions of a) and b) are applicable only if all these persons have their habitual residence in the State of registration. The same is true even though these persons are also victims of the accident. Article 5 The law applicable under Articles 3 and 4 to liability towards a passenger who is a victim governs liability for damage to goods carried in the vehicle and which either belong to the passenger or have been entrusted to his care. The law applicable under Articles 3 and 4 to liability towards the owner of the vehicle governs liability for damage to goods carried in the vehicle other than goods covered in the preceding paragraph. Liability for damage to goods outside the vehicle or vehicles is governed by the internal law of the State

where the accident occurred. However the liability for damage to the personal belongings of the victim outside the vehicle or vehicles is governed by the internal law of the State of registration when that law would be applicable to the liability towards the victim according to Article

4. Article 6 In the case of vehicles which have no registration or which are registered in several States the internal law of the State in which they are habitually stationed shall replace the law of the State of registration. The same shall be true if neither the owner nor the person in possession or control nor the driver of the vehicle his habitual residence in the State of registration at the time of the accident. Article 7 Whatever may be the applicable law, in determining liability account shall be taken of rules relating to the control and safety of traffic which were in force at the place and time of the accident. Article 8 The applicable law shall determine, in particular: (1) the basis and extent of liability; (2) the grounds for exemption from liability, any limitation of liability and any division of liability; (3) the existence and kinds of injury or damage which may have to be compensated; (4) the kinds and extent of damages; (5) the question whether a right to damages may be assigned or inherited; (6) the persons who have suffered damage and who may claim damages in their own right; (7) the liability of a principal for the acts of his agent or of a master for the acts of his servant; (8) rules of prescription and limitation, including rules relating to the commencement of a period of prescription or limitation, and the interruption and suspension of this period. Article 9 Persons who have suffered injury or damage shall have a right of direct action against the insurer of the person liable if they have such a right, under the law applicable according to Articles 3, 4 or

5. If the law of the State of registration is applicable under Articles 4 or 5 and that law provides no right of direct action, such a right shall nevertheless exist if it is provided by the internal law of the State where the accident occurred. If neither of these laws provides any such right it shall exist if it is provided by the law governing the contract of insurance.

of ratification referred to in the second paragraph of Article

16. The Convention shall enter into force for each signatory State which ratifies subsequently on the sixtieth day after the deposit of its instrument of ratification. Article 18

The application of any of the laws declared applicable by the present Convention may be refused only when it is manifestly contrary to public policy (‘ordre public’). Article 11 The application of Articles 1 to 10 of this Convention shall be independent of any requirement of reciprocity. The Convention shall be applied even if the applicable law is not that of a Contracting State. Article 12 Every territorial entity forming part of a State having a non-unified legal system shall be considered as a State for the purposes of Articles 2 to 11 when it has its own legal system, in respect of civil non-contractual liability arising from traffic accidents. Article 13 A State having a non-unified legal system is not bound to apply this Convention to accidents occurring in that State which involve only vehicles registered in territorial units of that State. Article 14 A State having a non-unified legal system may, at the time of signature, ratification or accession, declare that this Convention shall extend to all its legal systems or only to one or more of them, and may modify its declaration at any time thereafter, by making a new declaration. These declarations shall be notified to the Ministry of Foreign Affairs of the Netherlands and shall state expressly the legal systems to which the Convention applies. Article 15 This Convention shall not prevail over other conventions in special fields to which the Contracting States are or may become Parties and which contain provisions concerning civil non-contractual liability arising out of a traffic accident. Article 16 The present Convention shall be open for signature by the States represented at the Eleventh Session of the Hague Conference on Private International Law. It shall be ratified, and the instruments of ratification shall be deposited with the Ministry of Foreign Affairs of the Netherlands. Article 17 The present Convention shall enter into force on the sixtieth day after the deposit of the third instrument

Any State not represented at the Eleventh Session of the Hague Conference on Private International Law which is a Member of this Conference or of the United Nations or of a specialized agency of that Organization, or a Party to the Statute of the International Court of Justice may accede to the present Convention after it has entered into force in accordance with the first paragraph of Article

17. The instrument of accession shall be deposited with the Ministry of Foreign Affairs of the Netherlands. The Convention shall enter into force for a State acceding to it on the sixtieth day after the deposit of its instrument of accession. The accession will have effect only as regards the relations between the acceding State and such Contracting States as will have declared their acceptance of the accession. Such a declaration shall be deposited at the Ministry of Foreign Affairs of the Netherlands; this Ministry shall forward, through diplomatic channels, a certified copy to each of the Contracting States. The Convention will enter into force as between the acceding State and the State having declared to accept the accession on the sixtieth day after the deposit of the declaration of acceptance. Article 19 Any State may, at the time of signature, ratification or accession, declare that the present Convention shall extend to all the territories for the international relations of which it is responsible, or to one or more of them. Such a declaration shall take effect on the date of entry into force of the Convention for the State concerned. At any time thereafter, such extensions shall be notified to the Ministry of Foreign Affairs of the Netherlands. The Convention shall enter into force for the territories mentioned in such an extension on the sixtieth day after the notification indicated in the preceding paragraph. Article 20 The present Convention shall remain in force for five years from the date of its entry into force in accordance with the first paragraph of Article 17, even for States which have ratified it or acceded to it subsequently.

If there has been no denunciation, it shall be renewed tacitly every five years. Any denunciation shall be notified to the Ministry of Foreign Affairs of the Netherlands at least six months before the end of the five year period. It may be limited to certain of the territories to which the Convention applies. The denunciation shall have effect only as regards the State which has notified it. The Convention shall remain in force for the other Contracting States. Article 21 The Ministry of Foreign Affairs of the Netherlands shall give notice to the States referred to in Article 16, and to the States which have acceded in accordance with Article 18 of the following: a) the signatures and ratifications referred to in Article 16;

b) the date on which the present Convention enters into force in accordance with the first paragraph of Article 17; c) the accessions referred to in Article 18 and the dates on which they take effect; d) the declarations referred to in Articles 14 and 19; e) the denunciations referred to in the third paragraph of Article

20. In witness whereof the undersigned, being duly authorized thereto, have signed the present Convention. Done at The Hague, on the 4th day of May, 1971, in the English and French languages, both texts being equally authentic, in a single copy which shall be deposited in the archives of the Government of the Netherlands, and of which a certified copy shall be sent, through the diplomatic channel, to each of the States represented at the Eleventh Session of the Hague Conference on Private International Law.

CONVENTION SUR LA LOI APPLICABLE EN MATIÈRE D’ACCIDENTS DE LA CIRCULATION ROUTIÈRE Les Etats signataires de la présente Convention, Désirant établir des dispositions communes concernant la loi applicable ∫ la responsabilité civile extra-contractuelle en mati¯re d’accidents de la circulation routi¯re, Ont résolu de conclure une Convention ∫ cet effet et sont convenus des dispositions suivantes: Article premier La présente Convention détermine la loi applicable ∫ la responsabilité civile extra-contractuelle découlant d’un accident de la circulation routiére, quelle que soit la nature de la juridiction appelée ∫ en connaitre. Par accident de la circulation routi¯re au sens de la présente Convention, on entend tout accident concernant un ou des véhicules, automoteurs ou non, et qui est lié ∫ la circulation sur la voie publique, sur un terrain ouvert au public ou sur un tarrain non public mais ouvert ∫ un certain nombre de personnes ayant le droit de le fréquenter. Article 2 La présente Convention ne s’applique pas:

1. ∫ la reponsabilité des fabricants, vendeurs et réparateurs de véhicules;

2. ∫ la reponsabilité du propriétaire de la voie de circulation ou de toute autre personne tenue d’assurer l’entretien de la voie ou la sécurité des usagers;

3. aux reponsabilités du fait d’autrui, ∫ l’exception de celle du propriétaire du véhicule et de celle du commettant;

4. aux recours entre personnes responsables;

5. aux recours et aux subrogations concernant les assureurs;

6. aux actions et aux recours exercés par ou contre les organismes de sécurité sociale, d’assurance sociale ou autres institutions analogues et les fonds publics de garantie automobile, ainsi qu’aux cas d’exclusion de responsabilité prévus par la loi dont relévent ces organismes. Article 3 La loi applicable est la loi interne de l’Etat sur le territoire duquel l’accident est survenu. Article 4 Sous reserve de l’article 5, il est dérogé ∫ la disposition de l’article 3 dans les cas prévus ci-apr¯s: a) Lorsqu’un seul véhicule est impliqué dans l’accident et qu’il est immatriculé dans un Etat autre que celui sur le territoire duquel l’accident est survenu, la loi interne de l’Etat d’immatriculation est applicable ∫ la responsabilité — envers le conducteur, le détenteur, le propriétaire ou toute autre personne ayant un droit sur le véhicule, sans qu’il soit tenu compte de leur résidence habituelle,

— envers une victime qui était passager, si elle avait sa résidence habituelle dans un Etat autre que celui sur le territoire duquel l’accident est survenu, — envers une victime se trouvant sur les lieux de l’accident hors du véhicule, si elle avait sa résidence habituelle dans l’Etat d’immatriculation. En cas de pluralité de victimes, la loi applicable est déterminée séparément ∫ l’égard de chacune d’entre elles. b) Lorsque plusieurs véhicules sont impliqués dans l’accident, les dispositions figurant sous lettre a) ne sont applicables que si tous les véhicules sont immatriculés dans le m˘me Etat. c) Lorsque des personnes se trouvant sur les lieux de l’accident hors du ou des véhicules sont impliquées dans l’accident, les dispositions figurant sous lettres a) et b) ne sont applicables que si toutes ces personnes avaient leur résidence habituelle dans l’Etat d’immatriculation. Il en est ainsi, alors m˘me qu’elles sont aussi victimes de l’accident. Article 5 La loi applicable en vertu des articles 3 et 4 ∫ la responsabilité envers le passager régit aussi la responsabilité pour les dommages aux biens transportés dans le véhicule, qui appartiennent au passager ou qui lui ont été confiés. La loi applicable en vertu des articles 3 et 4 ∫ la responsabilité envers le propriétaire du véhicule régit la responsabilité pour les dommagers aux biens transportés par le véhicule, autres que ceux visés ∫ l’alinéa précédent. La loi applicable ∫ la responsabilité pour les dommages aux biens se trouvant hors du ou des véhicules est celle de l’Etat sur le territoire duquel l’accident est survenu. Toutefois, la reponsabilité pour les dommages aux effets personnels de la victime se trouvant hors du ou des véhicules est soumise ∫ la loi interne de l’Etat d’immatriculation, lorsqu’elle est applicable ∫ la responsabilité envers la victime en vertu de l’article

4. Article 6 Pour les véhicules non immatriculés ou immatriculés dans plusieurs Etats, la loi interne de l’Etat du stationnement habituel remplace celle de l’Etat d’immatriculation. Il en est de m˘me lorsque ni le propriétaire, ni le détenteur, ni le conducteur du véhicule n’avaient, au moment de l’accident, leur résidence habituelle dans l’Etat d’immatriculation. Article 7 Quelle que soit la loi applicable, il doit, dans la détermination de la responsabilité, ˘tre tenu compte des r¯gles de circulation et de sécurité en vigueur au lieu et au moment de l’accident.

2. les couses d’exonération, ainsi que toute limitation et tout partage de reponsabilité;

3. l’existence et la nature des dommages susceptibles de réparation;

4. les modalités et l’étendue de la réparation;

5. la transmissibilité du droit ∫ réparation;

6. les personnes ayant droit ∫ réparation du dommage qu’elles ont personnellement subi;

7. la responsabilité du commettant du fait de son préposé;

8. les prescriptions et les déchéances fondées sur l’expiration d’un délai, y compris le point de départ, l’interruption et la suspension des délais. Article 9 Les personnes lésées ont le droit d’agir directement contre l’assureur du responsable, si un tel droit leur est reconnu par la loi applicable en vertu des articles 3, 4 ou

5. Si la loi de l’Etat d’immatriculation, applicable en vertu des articles 4 ou 5, ne connait pas ce droit, il peur néanmoins ˘tre exercé s’il est admis par la loi interne de l’Etat sur le territoire duquel l’accident est survenu. Si aucune de ces lois ne connait ce droit, il peut ˘tre exercé s’il est admis par la loi du contrat d’assurance. Article 10 L’application d’un des lois déclarées compétentes par la présente Convention ne peut ˘tre écartée que si elle est manifestement incompatible avec l’ordre public. Article 11 L’application des articles 1 ∫ 10 de la présente Convention est indépendante de toute condition de réciprocité. La Convention s’applique m˘me si la loi applicable n’est pas celle d’un Etat contractant. Article 12 Toute unité territoriale faisant partie d’un Etat ∫ systéme juridique non unifié est considérée comme un Etat pour l’application des articles 2 ∫ 11, lorsqu’elle a son propre syst¯me de droit concernant la responsabilité civile extra-contractuelle en mati¯re d’accidents de la circulation routi¯re. Article 13 Un Etat ∫ syst¯me juridique non unifié n’est pas tenu d’appliquer la présente Convention aux accidents survenus sur son territoire, lorsqu’ils concernent des véhicules qui ne sont immatriculés que dans les unités territoriales de cet Etat.

Un Etat ∫ systéme juridique non unifié pourra, au moment de la signature, de la ratification ou de l’adhésion, déclarer que le présente Convention s’étendra ∫ tous ses syst¯mes de droit ou seulement ∫ un ou plusieurs d’entre eux et pourra ∫ tout moment modifier cette déclaration en faisant une nouvelle déclaration. Ces déclarations seront notifiées au Minist¯re des Affaires Etrang¯res des Pays-Bas et indiqueront expressément les syst¯mes de droit ∫uxquels la Convention s’applique. Article 15 La présente Convention ne déroge pas aux conventions auxquelles les Etats contractants sont ou seront Parties et qui, dans des mati¯res particuli¯res, r¯glent la responsabilité civile extra-contractuelle découlant d’un accident de la circulation routi¯re. Article 16 La présente Convention est ouverte ∫ la signature des Etats représentés ∫ la Onzi¯me session de la Conférence de La Haye de droit international privé. Elle sera ratifiée et les instruments de ratification seront déposés aupr¯s du Minist¯re des Affaires Etrang¯res des Pays-Bas. Article 17 La présente Convention entrera en vigueur le soixanti¯me jour apr¯s le dépôt du troisi¯me instrument de ratification prévu par l’article 16, alinéa

2. La Convention entrera en vigueur, pour chaque Etat signataire ratifiant postérieurement, le soixanti¯me jour aprés le dépôt de son instrument de ratification. Article 18 Tout Etat non représenté ∫ la Onzi¯me session de la Conférence de La Haye de droit international privé qui est Membre de cette Conférence ou de l’Organisation des Nations Unies ou d’une institution spécialisée de celle-ci ou Partie au Statut de la Cour internationale de Justice pourra adhérer ∫ la présente Convention apr¯s son entrée en vigueur en vertu de l’article 17, alinéa premier. L’instrument d’adhésion sera déposé aupr¯s du Minist¯re des Affaires Etrang¯res des Pays-Bas. La Convention entrera en vigueur, pour l’Etat adhérant, le soixanti¯me jour apr¯s le dépôt de son instrument d’adhésion. L’adhésion n’aura d’effet gue dans les rapports entre l’Etat adhérant et les Etats contractans gui auront déclaré accepter cette adhésion. Cette déclaration sera déposée auprés du Minist¯re des Affaires Etrang¯res des Pays-Bas; celui-ci en enverra, par la voie diplomatique, une copie certifiée conforme, ∫ chacun des Etats contractants. La Convention entrera en vigueur entre l’Etat adhérant et l’Etat ayant déclaré accepter cette adhésion

soixante jours apr¯s le dépôt de la déclaration d’acceptation. Article 19 Tout Etat, au moment de la signature, de la ratification ou de l’adhésion, pourra déclarer que la présente Convention s’étendra ∫ l’ensemble des territoires qu’il représente sur le plan international, ou ∫ l’un ou plusieurs d’entre eux. Cette déclaration aura effet au moment de l’entrée en vigueur de la Convention pour ledit Etat. Par la suite, toute extension de cette nature sera notifiée au Minist¯re des Affaires Etrang¯res des PaysBas. La Convention entrera en vigueur, pour les territoires visés par l’extension, le soixanti¯me jour apr¯s la notification mentionnée ∫ l’alinéa précédent. Article 20 La présente Convention aura une durée de cinq ans ∫ partir de la date de son entrée en vigueur conformément ∫ l’article 17, alinéa premier, m˘me pour les Etats qui l’auront ratifiée ou y auront adhéré postérieurement. La Convention sera renouvelée tacitement de cinq en cinq ans, sauf dénonciation. La dénonciation sera, au moins six mois avant l’expiration du délai de cinq ans, notifiée au Minist¯re des Affaires Etrang¯res des Pays-Bas. Elle pourra se limiter ∫ certains des territoires auxquels s’applique la Convention. La dénonciation n’aura d’effet qu’∫ l’égard de l’Etat qui l’aura notifiée. La Convention restera en vigueur pour les autres Etats contractants. Article 21 Le Ministére des Affaires Etrang¯res des Pays-Bas notifiera aux Etats visés ∫ l’article 16, ainsi qu’aux Etats qui auront adhéré conformément aux dispositions de l’article 18: a) les signatures et ratifications visées ∫ l’article 16; b) la date ∫ laquelle la présente Convention entrera en vigueur conformément aux dispositions de l’article 17, alinéa premier; c) les adhésions visées ∫ l’article 18 et la date ∫ laquelle elles auront effet; d) les déclarations mentionnées aux articles 14 et 19; e) les dénonciations visées ∫ l’article 20, alinéa

3. En foi de quoi, les soussignés, dûment autorisés, ont signé la présente Convention. Fait ∫ La Haye, le 4 mai 1971, en fran˜ais et en anglais, les deux textes faisant également foi, en un seul exemplaire, qui sera déposé dans les archives du Gouvernement des Pays-Bas et dont une copie certifiée conforme sera temise, par la voie diplomatique, ∫ chacun des Etats représentés ∫ la Onzi¯rne session de la Conférence de La Haye de droit international privé.
