EUROPEJSKIE POROZUMIENIE w sprawie zniesienia wiz dla uchodźców, sporządzone w Strasburgu dnia 20 kwietnia 1959 r. W imieniu Rzeczypospolitej Polskiej PREZYDENT RZECZYPOSPOLITEJ POLSKIEJ podaje do powszechnej wiadomości: W dniu 20 kwietnia 1959 r. zostało sporządzone w Strasburgu Europejskie porozumienie w sprawie zniesienia wiz dla uchodźców, w następującym brzmieniu: Przekład EUROPEJSKIE POROZUMIENIE w sprawie zniesienia wiz dla uchodźców Rządy sygnatariusze niniejszego porozumienia, będące Członkami Rady Europy, pragnąc ułatwić przemieszczanie się uchodźców stale przebywających na ich terytorium, uzgodniły, co następuje: Artykuł 1

1. Na mocy niniejszego porozumienia i na zasadzie wzajemności uchodźcy stale przebywający zgodnie z prawem na terytorium Umawiającej się Strony zwolnieni są z obowiązku uzyskiwania wiz w celu wjazdu lub wyjazdu na terytorium innej Umawiającej się Strony przez dowolną granicę, pod warunkiem: EUROPEAN AGREEMENT on the abolition of visas for refugees The Governments signatory hereto, being Members of the Council of Europe, Desirous of facilitating travel for refugees residing in their territory, Have agreed as follows: Article 1

1. Refugees lawfully resident in the territory of a Contracting Party shall be exempt, under the terms of this Agreement and subject to reciprocity, from the obligation to obtain visas for entering or leaving the territory of another Party by any frontier, provided that: ACCORD EUROPÉEN relatif ∫ la suppression des visas pour les réfugiés Les Gouvernements signataires, Membre du Conseil de l’Europe, Désireux de faciliter les voyages des réfugiés résidant sur leurs territoires, Sont convenus de ce qui suit: Article 1er

1. Les réfugiés résidant réguli¯rement sur le territoire d’une des Parties Contractantes seront dispensés, aux termes du présent Accord et sous condition de réciprocité, de la formalité des visas pour entrer sur le territoire des autres Parties Contractantes et en sortir par toutes les fronti¯res ∫ condition:



Dziennik Ustaw Nr 225 (a) posiadania ważnego dokumentu podróży wystawionego zgodnie z Konwencją dotyczącą statusu uchodźców z dnia 28 lipca 1951 r. lub Porozumieniem dotyczącym wydawania dokumentów podróży uchodźcom z dnia 15 października 1946 r. przez organy Umawiającej się Strony, na której terytorium uchodźcy ci zgodnie z prawem stale przebywają, (b) że wizyta nie trwa dłużej niż trzy miesiące.

2. Wiza może być wymagana w przypadku pobytu dłuższego niż trzy miesiące lub w celu uzyskania płatnego zatrudnienia na terytorium innej Umawiającej się Strony. Artykuł 2 Dla celów niniejszego porozumienia „terytorium” Umawiającej się Strony ma znaczenie przypisane przez tę Stronę w deklaracji skierowanej do Sekretarza Generalnego Rady Europy. Artykuł 3 W zakresie uznanym za konieczny przez jedną lub więcej Umawiających się Stron granica będzie przekraczana wyłącznie w wyznaczonych przejściach granicznych. Artykuł 4

1. Postanowienia niniejszego porozumienia nie ograniczają przepisów prawa dotyczących wizyt obcokrajowców na terytorium innej Umawiającej się Strony.

2. Każda Umawiająca się Strona zastrzega sobie prawo zakazu wjazdu lub pobytu na swoim terytorium osobom uznanym za niepożądane. Artykuł 5 Uchodźcy, którzy na mocy niniejszego porozumienia znaleźli się na terytorium Umawiającej się Strony, zostaną w dowolnym czasie ponownie wpuszczeni na terytorium Umawiającej się Strony,                — 14945 — (a) they hold a valid travel document issued in accordance with the Convention on the Status of Refugees of 28th July 1951 or the Agreement relating to the issue of a travel document to refugees of 15th October 1946, by the authorities of the Contracting Party in whose territory they are lawfully resident; (b) their visit is of not more than three months’ duration.

2. A visa may be required for a stay of longer than three months or for the purpose of taking up gainful employment in the territory of another Contracting Party. Article 2 For the purposes of the present Agreement the ”territory” of a Contracting Party shall have the meaning assigned to it by this Party in a declaration addressed to the SecretaryGeneral of the Council of Europe. Article 3 To the extent that one or more Contracting Parties deem necessary, the frontier shall be crossed only at authorised points.                Poz. 1929

2. Le visa peut ˘tre exigé pour tous les séjours d’une durée supérieure ∫ trois mois ou pour toute entrée sur le territoire d’une autre Partie en vue d’y exercer une activité lucrative. Article 2 Le terme «territoire» d’une Partie Contractante aura, en ce qui concerne le présent Accord, la signification que cette Partie lui attribuera dans une déclaration adressée au Secrétaire Général du Conseil de l’Europe. Article 3 Dans la mesure où l’une ou plusieurs des Parties Contractantes le jugerait nécessaire, le franchissement de la fronti¯re n’aura lieu qu’aux postes autorisés. Article 4

1. Les dispositions du présent Accord ne portent pas atteinte aux prescriptions légales et réglementaires relatives au séjour des étrangers sur le territoire de chacune des Parties Contractantes.

2. Chacune des Parties Contractantes se réserve le droit de refuser l’acc¯s ou le séjour sur son territoire aux personnes qu’elle consid¯re comme indésirables. Article 5 Les réfugiés qui se sont rendus sur le territoire d’une Partie Contractante sous le bénéfice des dispositions du présent Accord seront réadmis ∫ tout moment sur le territoire de la Partie Contractante

Article 4

1. The provisions of this Agreement shall be without prejudice to the laws or regulations governing visits by aliens to the territory of any Contracting Party.

2. Each Contracting Party reserves the right to prohibit persons it deems to be undesirable from entering or staying in its territory. Article 5 Refugees who have entered the territory of a Contracting Party by virtue of the present Agreement shall be re-admitted at any time to the territory of the Contracting Party by whose authorities the travel



Dziennik Ustaw Nr 225 której organy wydały dokument podróży, na zwykłe żądanie Strony, o której mowa na wstępie, z wyjątkiem sytuacji, kiedy Strona ta zezwoliła zainteresowanym osobom na osiedlenie się na swoim terytorium. Artykuł 6 Niniejsze porozumienie nie ogranicza pozostających w mocy lub mogących wejść w życie przepisów prawa wewnętrznego ani dwustronnych lub wielostronnych traktatów, konwencji ani porozumień, na podstawie których do uchodźców legalnie stale przebywających na terytorium Umawiającej się Strony stosuje się łagodniejsze warunki przekraczania granic. Artykuł 7

1. Każda Umawiająca się Strona zastrzega sobie dla potrzeb porządku publicznego, bezpieczeństwa lub zdrowia publicznego możliwość opóźnienia wejścia w życie niniejszego porozumienia lub zarządzenia czasowego zawieszenia jego stosowania w stosunku do wszystkich lub niektórych pozostałych Stron, z wyjątkiem postanowień artykułu

5. Sekretarz Generalny Rady Europy zostanie niezwłocznie poinformowany o podjęciu takich środków oraz o ich zniesieniu.

2. Umawiająca się Strona, która skorzysta z możliwości przewidzianej w poprzedzającym ustępie, nie może domagać się stosowania niniejszego porozumienia przez inną ze Stron, z wyjątkiem zakresu, w jakim sama je stosuje w odniesieniu do tej Strony. Artykuł 8 Niniejsze porozumienie będzie otwarte do podpisu przez Członków Rady Europy, którzy mogą stać się Stronami porozumienia poprzez: (a) podpisanie bez zastrzeżenia ratyfikacji albo (b) podpisanie z zastrzeżeniem ratyfikacji, po którym nastąpi ratyfikacja.                — 14946 — document was issued, at the simple request of the firstmentioned Party, except where this Party has authorised the persons concerned to settle in its territory.                Poz. 1929

Article 7

1. Chacune des Parties Contractantes se réserve la faculté, pour des raisons relatives ∫ l’ordre public, ∫ la sécurité ou ∫ la santé publique, de ne pas appliquer immédiatement le présent Accord ou d’en suspendre temporairement l’application ∫ l’égard des autres Parties ou de certaines d’entre elles, sauf en ce qui concerne les dispositions de l’article

5. Cette mesure sera immédiatement notifiée au Secrétaire Général du Conseil de l’Europe. Il en sera de m˘me d¯s que la mesure en question sera levée.

2. Toute Partie Contractante qui se prévaudra de l’une des facultés prévues ∫ l’alinéa précédent ne pourra prétendre ∫ l’application du présent Accord par une autre Partie que dans la mesure où elle l’appliquera elle-m˘me ∫ l’égard de cette Partie. Article 8 Le présent Accord est ouvert ∫ la signature des Membres du Conseil de l’Europe qui peuvent y devenir Partie par: (a) la signature sans réserve de ratification, (b) la signature sous réserve de ratification suivie de ratification.

Article 6 This Agreement shall not prejudice the provisions of any municipal law or bilateral or multilateral treaties, conventions or agreements now in force or which may hereafter enter into force, whereby more favourable terms are applied to refugees lawfully resident in the territory of a Contracting Party in respect of the crossing of frontiers.

Article 7

1. Each Contracting Party reserves the option, for reasons of ordre public, security or public health, to delay the entry into force of this Agreement, or order the temporary suspension thereof in respect of all or some of the other Parties, except in so far as the provisions of Article 5 are concerned. The Secretary-General of the Council of Europe shall immediately be informed when any such measure is taken and again when it ceases to be operative.

2. A Contracting Party which avails itself of either of the options provided for in the foregoing paragraph may not claim the application of this Agreement by another Party save in so far as it also applies it in respect of that Party. Article 8 This Agreement shall be open to the signature of Members of the Council of Europe, who may become Parties thereto either by: (a) signature without reservation in respect of ratification, or (b) signature with reservation in respect of ratification, followed by ratification.

1. Niniejsze porozumienie wchodzi w życie jeden miesiąc po dniu, w którym trzech Członków Rady Europy zgodnie z artykułem 8 podpisze porozumienie bez zastrzeżenia ratyfikacji lub ratyfikuje porozumienie.

2. W przypadku Członka Rady Europy, który w terminie późniejszym podpisze porozumienie bez zastrzeżenia ratyfikacji lub je ratyfikuje, porozumienie wejdzie w życie jeden miesiąc od dnia, w którym zostało podpisane lub dnia, w którym został złożony dokument ratyfikacyjny. Artykuł 10 Po wejściu w życie niniejszego porozumienia Komitet Ministrów Rady Europy może jednogłośnie zaprosić Rząd niebędący Członkiem Rady, będący natomiast stroną Konwencji dotyczącej statusu uchodźców z dnia 28 lipca 1951 r. lub Porozumienia dotyczącego wydawania dokumentów podróży uchodźcom z dnia 15 października 1946 r., do przystąpienia do niniejszego porozumienia. Takie przystąpienie nabierze mocy jeden miesiąc od dnia złożenia dokumentu przystąpienia u Sekretarza Generalnego Rady Europy. Artykuł 11 Sekretarz Generalny Rady Europy zawiadomi Państwa Członkowskie Rady i Państwa przystępujące do niniejszego porozumienia: (a) o każdym podpisaniu z zastrzeżeniem ratyfikacji, o złożeniu każdego dokumentu ratyfikacyjnego i o dniu wejścia porozumienia w życie, (b) o złożeniu każdego dokumentu przystąpienia zgodnie z artykułem 10, (c) o każdym zawiadomieniu lub deklaracji otrzymanych zgod                — 14947 — Instruments of ratification shall be deposited with the SecretaryGeneral of the Council of Europe. Article 9

1. The Agreement shall enter into force one month after the date on which three Members of the Council, in accordance with Article 8, shall have signed the Agreement without reservation in respect of ratification or shall have ratified it.

2. In the case of any Member who shall subsequently sign the Agreement without reservation in respect of ratification, or shall ratify it, the Agreement shall enter into force one month after the date of such signature or the date of deposit of the instrument of ratification. Article 10 After this Agreement has entered into force the Committee of Ministers of the Council of Europe may, by unanimous vote, invite any Government not a Member of the Council, which is party either to the Convention on the Status of Refugees of 28th July 1951 or to the Agreement relating to the issue of a travel document to refugees of 15th October 1946, to accede to this Agreement. Such accession shall take effect one month after the date of deposit of the instrument of accession with the SecretaryGeneral of the Council of Europe. Article 11 The SecretaryGeneral of the Council of Europe shall notify Member States of the Council and States acceding to this Agreement: (a) of every signature, with any reservations in respect of ratification, of the deposit of each instrument of ratification, and of the date on which the Agreement enters into force; (b) of the deposit of any instrument of accession in accordance with Article 10; (c) of any notification or declaration received in accordance                Poz. 1929

Les instruments de ratification seront déposés pr¯s le Secrétaire Général du Conseil de l’Europe. Article 9

1. Le présent Accord entrera en vigueur un mois apr¯s la date ∫ laquelle trois Membres du Conseil, conformément aux dispositions de l’article 8, auront signé l’Accord sans réserve de ratification ou l’auront ratifié.

2. Pour tout Membre qui, ultérieurement, signera l’Accord sans réserve de ratification ou le ratifiera, l’Accord entrera en vigueur un mois apr¯s la date de la signature ou du dépôt de l’instrument de ratification.

Article 10 Apr¯s l’entrée en vigueur du présent Accord, le Comité des Ministres du Conseil de l’Europe peut inviter, par un vote pris ∫ l’unanimité, tout gouvernement non Membre du Conseil qui est Partie soit ∫ la Convention relative au Statut des Réfugiés du 28 juillet 1951, soit ∫ l’Accord concernant la délivrance d’un titre de voyage aux réfugiés du 15 octobre 1946, ∫ adhérer au présent Accord. L’adhésion prendra effet un mois apr¯s la date du dépôt de l’instrument d’adhésion aupr¯s du Secrétaire Général du Conseil de l’Europe. Article 11 Le Secrétaire Général du Conseil de l’Europe notifiera aux Membres du Conseil et aux États adhérents: (a) toutes signatures avec les réserves éventuelles de ratification, le dépôt de tout instrument de ratification et la date de l’entrée en vigueur du présent Accord; (b) le dépôt de tout instrument d’adhésion effectué en application de l’article 10; (c) toute notification ou déclaration re˜ue en application des

Artykuł 12 Każda Umawiająca się Strona może wypowiedzieć stosowanie niniejszego porozumienia poprzez zawiadomienie o tym, z trzymiesięcznym wyprzedzeniem, Sekretarza Generalnego Rady Europy. NA DOWÓD CZEGO, niżej podpisani, należycie w tym celu upoważnieni, podpisali niniejsze porozumienie. SPORZĄDZONO w Strasburgu dnia 20 kwietnia 1959 r., w językach angielskim i francuskim, przy czym obydwa teksty mają jednakową moc, w jednym egzemplarzu, który zostanie złożony w archiwach Rady Europy. Sekretarz Generalny przekaże uwierzytelnione kopie Rządom sygnatariuszom.                — 14948 — with Articles 2, 7 and 12, and the date on which it takes effect. Article 12 Any Contracting Party may terminate its own application of the Agreement by giving three months’ notice to that effect to the SecretaryGeneral of the Council of Europe. IN WITNESS WHEREOF the undersigned, being duly authorised thereto, have signed this Agreement. DONE at Strasbourg, this 20th day of April 1959, in English and French, both texts being equally authoritative, in a single copy which shall remain deposited in the archives of the Council of Europe. Po zaznajomieniu się z powyższym porozumieniem, w imieniu Rzeczypospolitej Polskiej oświadczam, że: — zostało ono uznane za słuszne zarówno w całości, jak i każde z postanowień w nim zawartych, — jest przyjęte, ratyfikowane i potwierdzone, — będzie niezmiennie zachowywane.
